Division personnel have reviewed and approved your application for the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9. 1994 (or as
subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources, the
Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,

is hereby authorized to discharge wastewater from a facility located at the
Stansted Subdivision Well #2
Stansted Drive
north of Fuquay-Varina
Wake County
to receiving waters designated as an unnamed tributary to Basal Creek in the Neuse
River Basin
in accordance with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective May 1, 2000.
This permit and authorization to discharge shall expire at midnight on April 30, 2003.

During the period beginning on the effective date of the permit and lasting until expiration, the

All samples collected should be of a representative discharge.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) Total Nitrogen Monitoring
The Permittee shall calculate the annual mass loading of total nitrogen as the sum of
monthly loadings, according to the following equations:
(1) Monthly Mass Loading (lb/month) = TN x g x 8.34
where:
TN = the average total nitrogen concentration (mg/L) of the grab samples
collected during the month
Q = the total wastewater flow discharged during the month (MG/month)
8.34 = conversion factor, from (mg/L x MG) to pounds
(2) Annual Mass Loading (lb/year) = E (Monthly Mass Loadings) for the calendar year
The Permittee shall report the total nitrogen concentration for each sample and the
Quarterly mass loading in the appropriate monthly self -monitoring report. The annual mass
loading of total nitrogen shall be reported in the December self -monitoring report.

Jerry, I discussed this project with Dave Goodrich yesterday. We
reviewed the modifications you requested. Dave gave me the following
responses:
If the system discharges <5000 gallons per day, the chlorine limit can
be removed.
A turbidity limit of 50 NTU can be given at the outfall, or upstream &
downstream turbidity monitoring (with no limit) can be given instead.
As with chlorine, if the system discharges <5000 gallons perday,
monitoring frequencies for other parameters can be changed from weekly
to monthly.
Please reply to this message and tell me:
the likely flow per day that the facility will discharge;
which method of turbidity monitoring you prefer.
Once I have your responses on these items I can finalize the permit.
The target issue date is March 21st.
Dave also wanted me to mention that he agrees with your sentiments on
the need for a General Permit for WTPs. However, our staff shortage has
forced many such projects off the table. The larger concern of toxicity
also must be investigated before a General Pemrit could be developed.

Re: Draft Permit No. NC0086690, Stansted Well Nol 2 _
Dear Mr. Weaver:
The above -referenced draft permit involves the backwash water from an
iron removal facility on one of Heater Utilities, Inc.'s (Heater) wells
producing drinking water for a subdivision. The testing frequencies on these
type facilities has historically been monthly with changes permissible to
quarterly after a track record has been established. I believe these
facilities should be permitted under a general permit due to the intermittent
nature of the discharge, the relatively small amount of discharge and the lack
of pollutants in the discharge.
The above -referenced draft permit includes weekly sampling for several
parameters and upstream and downstream sampling. The permit also includes a
chlorine limit on this insignificant discharge. There is currently no
dechlorination facilities included in the design.
It is requested that the stream monitoring be eliminated from the permit
as well as the chlorine limit and that the testing frequencies be changed to
monthly or quarterly on grab samples. There is no reasonable method to obtain
a composite sample on this type of discharge.
The testing requirements in this draft permit are excessive given the
amount and type of discharge under consideration.
Your favorable consideration to revising these testing requirements will

Summary
A request was received from the applicant (in March 1999) to permit the filter -backwash discharge from the well that
will be used for drinking water in the Stansted subdivision north of Fuquay-Varina. The application package was
inadequate and was returned. A revised application (submitted in June 1999) was assigned to a permit writer working
part-time for the Unit. The application was misfiled by the permit writer. the permit was not drafted until late
January 2000. This system is typical of such discharges and poses minimal risk to the receiving stream
The draft permit has the expanded nutrient monitoring present in all Neuse River basin permits, pursuant to the
Division's informal agreement with the Neuse River Foundation (NRF). The NRF has agreed to waive objections to
issuance of non -nutrient loaded discharge permits, provided that nutrient monitoring is conducted by those facilities.
The nutrient monitoring requirements in the draft permit are consistent with nutrient monitoring regimen in other
Neuse River WTP permits.
The receiving stream is not impaired or threatened. Basal Creek does not appear on the latest 303(d) list, nor do any
of its tributaries. There are no streams in subbasin 30403 present in the most recent 303(d) list.

Dear Mr. Weaver:
Enclosed is NPDES short form D for discharging filter backwash from a proposed well
to serve Stansted Subdivision which will be owned and operated by Heater Utilities.
In accordance with 15A NCAC 2H.015 (c) (2) we have evaluated the following
alternatives to discharge:
1) Concerning connection to the Town of Fuquay—Varina collection system, this
project is not within Fuquay-Varina's jurisdiction and the existing wastewater
collection system is approximately 2.5 miles south of this site.
2) The soils in this area are not suitable for a ground water absorption system.
3) The discharge from the filter, utilizing "Berm" as a media, would not add any
chemicals to the proposed backwash.
Please advise if additional information is required.
