Hi David and Holley
Based on input from the USAGE, Logan Development has revised their site plan for Malmo
Loop Rd Tract and will be avoiding impacts to jurisdictional features related to installing the
spine road. The only proposed impacts at this time will be those needed to construct Phase lA
off Malmo Loop Rd and authorized under the original NWP (less than 0.1 acre of impact; see
attached). Therefore, they wish to withdraw the Section 404/401 permit application that was
submitted on 8/25/23 and just use the NWP attached. Note that Gary issued a provisional
permit for Phase IA in 2022. I assume he thought that a 401 WQC was going to be needed,
but since impacts were under 0.1 acre, it wasn't. David- do you need to issue a final NWP?

As of 8/28/2023 I will be handling Brunswick County. I have started reviewing the
PCN for 2022-02583 Malmo Loop Tract _ Phase 1 and Spine Road. Currently, we
do not consider this application as being complete. This is because we cannot
determine the indirect impacts from the proposed installation of the spline road
(See Condition 32 of NWP 29). The proposed road appears that it will not be an
independent utility of the proposed development along Malmo Loop but will be
used for multiple phases and future development. When making minimal adverse
environmental effects determinations the district engineer will consider the direct
and indirect effects caused by the NWP activity. We would need to look at all
potential development plans that this road would service. If you would like to
discuss this further, please feel free to contact me and we can set up a time.
