The following comments are provided under authority of G. S. 113-131.
The Division of Marine Fisheries had no objection to the subject project in our response dated 21 January
2005. The inside ends of the applicant's two 10-slip community docks would be more than 650 ft apart, which is
acceptable.
However, additional information has come to light concerning this CAMA major permit application. Per a
14 February 2005 memo from Lees Sabo (DEH Shellfish Sanitation and Recreational Water Quality Section), Mr.
A. C. Skinner owns a lot about halfway between the applicant's two 10-slip community docks, and Mr. Skinner
has received a CAMA major permit fora 10-slip community dock offshore his property. Thus three 10-slip
community docks would be permitted within a 750 ft section of designated SA, open shellfishing waters. The
memo from DEH Shellfish Sanitation and Recreational Water Quality Section states that the three ten-slip
facilities would "pose the same threat as would a 30 slip marina." The Shellfish Sanitation and Recreational
Water Quality Section would, therefore, recommend a shellfishing closure of the facilities and 150 ft beyond the
facilities if all three facilities were built. This closure would result in loss of an existing use: shellfish harvest.
Such loss would be a violation of the federal Clean Water Act, as well as similar State laws, rules, and policies.
Such a loss cannot be allowed. Therefore, the Division of Marine Fisheries finds that this project will have a
significant adverse impact to the fisheries of the project area, and recommends denial of the subject application.
