SUBJECT: Environmental Management Commission Settlement Agreement
Quarterly Status Report
Town of Burnsville Collection System
NPDES PERMIT NCO020290 and WQCS00143
Dear Mr. Davidson:
This Quarterly Report documents the Town of Burnsville Sewer Collection System compliance activities
during July, August, and September 2023.
The Town has experienced no SSO's and the Pine Swamp treatment facility has operated within
permitted limits during the period of this quarterly report.
Project 3b-OMC Pump Station Flow Reduction
The project to install an additional pump at the OMC Pump Station to divert between 50-70,000 GPD of
flow to the EY Sewer District's treatment facility located East of Burnsville has been completed. Yancey
County has committed to obligating a portion of their 2021 State Budget Infrastructure funding for the
construction of force main to connect. The Town previously secured engineering services for the design
and bids for the force main connection to the EYWSD collection system. We are awaiting design
information from the engineering firm McGill Associates. The collection system has just recently been
completed. The County has obligated funding from their above mentioned earmark for camera
inspection, cleaning and inspection of portions of the EY Sewer District's collection system and repairs
and upgrades to the EY-WWTP as were outlined in a document sent to the County Manager dated April
20, 2022 from the ARO. The total amount allocated for these inspections and repairs will be $1.5 million.
The Department has issued a LOIF to the County and a milestone schedule for this project and the
County has selected McGill Associates engineering firm for the project.
Project 4-Baker's Creek Pump Station Rehabilitation
The project bid on September 19, 2023. The low bidder was Carolina Specialties Construction Co, Inc. Bid
information has been sent to DWI for approval and the Town Council passed a resolution of tentative
award at its October 4, 2023 regular business meeting pending DWI approval.

Project 5-West Main Sewer Interceptor Improvements
The project bid on August 31, 2023. The low bidder was CaJenn Construction. The bid was significantly
over budget, but the Town has made a request to the DEQ CDBG-1 division for some additional funding.
(see attached request letter and engineer report)
Project 7- Burnsville WWTP Improvements:
Funding for this project has now been increased to $8,850,000.00 after Yancey County agreed to
provide, from their State earmark, the additional $2.8 million in funding when the Town's application for
more grant funding from DWI was unsuccessful. The County has selected with WithersRavenel as the
Engineering Firm. We are awaiting legal review of the engineering contract from the County.
Additional Projects:
The Town in has secured grant funding through Yancey County from Dogwood Health Trust for the GIS
mapping of the sewer collection system. The sewer mapping project was completed in late November
2022. The water line mapping project is expected to be completed in early November 2023.
Additionally the same funding source will be used to complete an update of the 2016 AMP/CIP along
with an infrastructure master plan study to evaluate current conditions and capacity of all Town
infrastructure and future needs of both the Town and County. McGill and Associates has submitted a
draft of the updated AMP/CIP and Master Infrastructure study. They final draft will not be complete
until the water GIS mapping is available for inclusion. Work on the updating the SDF calculator continues
with a plan for public comment period that would allow adoption in the first quarter of 2024.
The Engineering Report for the East Main Sewer Interceptor Improvements was submitted to the
Division and approval letters were received on March 20, 2023. The engineers are moving forward with
the design and bid package for this project within the Division's timeline.
The Town Council is committed to improving and planning for future maintenance of the collection and
treatment systems. The Town looks forward to the forward progress of all these projects as we move
through the design phase and onto bidding and construction in accordance with the Division's timelines

Main Sewer Interceptor Improvements (West) Project - Additional Funds
Dear Ms. Simmons:
The Town of Burnsville received a CDBG-Infrastructure funding grant in April 2021 to rehabilitate the
Main Sewer Lines on the west side of Town from West Main Street to the WWTP. The total project was
estimated to cost, at the time of the application, $2,000,000 with a construction estimate of $1,602,000.
The project was put bid out for the first time on August 10, 2023, with only two proposals submitted. The
Town extended the bid submission deadline and advertised in a newspaper with a larger circulation as
well as personally contacted contractors who had purchased the bid specifications. On August 31, 2023
bids were opened for a second time, again only two proposals were submitted, with the low construction
cost coming in at $2,482,465, $880,465 over the CDBG-I estimated budget.
The Town and the Engineer have met with the low bidder, CaJenn Construction to negotiate the cost of
the project to fit the budget. Unfortunately, we were unable to reduce the cost of any of the unit prices,
nor was an alternative construction method feasible.
The next option is a reduction in the size of the project. In a quick examination of the sewer interceptor
line approximately 1,100 if of 8" line , 7001f of 10" line, 120 VF of manhole rehabilitation, and 25
service connections are not as old as the remaining line and can be eliminated from the project to bring
down the total cost. This reduction is expected to reduce the project cost by $300,000. This will still
leave the Town with a $580,456 deficit.
The Town of Burnsville would like to request additional CDBG funding, in the amount $500,000 from
the Department of Environmental Quality's FY2017, FY2018, or FY2019 deobligated CDBG funds to
complete the Main Sewer Interceptor Improvements (West) Project.
The Town, in the meantime, will be working with the Engineer and low bidder to negotiate a possible
reduction in work to bring the project construction cost down to no more than $2,102,000.

We have met with Billy Jennings, CaJenn Construction, on September 1, 2023 in an attempt to negotiate more favorable
pricing for the CDBG-I Main Sewer Rehabilitation Project. Billy was understanding of the situation but was not able to
offer pricing alternatives to achieve a lower bid total. We discussed the various unit item prices as well as an alternate
cementitious technology for rehabilitating the service laterals. Billy was unable to reduce any unit process but is willing to
hold the unit prices bid for reduced quantities of the various bid items. He indicated that while he had some familiarity
with the cementitious lining process, he had not utilized that method in many years and did not expect it to reduce the
project costs. He does not have personnel able to perform that work.
We subsequently reviewed the project on -site and met with Shane Dale, Public Works Director, in an effort to determine
what portion of the proposed work could be eliminated from the project without compromising the overall project goal of
eliminating significant inflow and infiltration into the system. It was determined that a portion of the proposed rehabilitation
area was not as old as the remainder of the area and can likely be eliminated from the project without significantly
reducing the project impacts to inflow/infiltration reduction. The area to be eliminated consists of approximately 1,100 LF
of 8-inch sewer, approximately 700 LF of 10-inch sewer, 120 VF of manhole rehabilitation, and 25 services that occur
along the line removed from the project. This is expected to reduce the overall project cost by approximately $300,000.
The CDBG-I grant application included an overall construction budget, including 10% contingency, of $1,602,000. Of that,
$145,630 is listed as contingency. The total price of the CaJenn bid is $2,482,465. Thus, even with the above listed work
eliminated from the project, a deficit of $580,465 remains. This amount of additional funding will be needed to complete
the intended work. Furthermore, It is strongly recommended that at least 5% contingency be maintained until near the
completion of the contract. 5% of the CaJenn bid is $124,123. We can work with the Town to set aside a portion of the
work for completion only after all other work is complete to ensure that sufficient contingency is available for unforeseen
site or construction issues.
If possible, we recommend that additional funding of up to $580,465 plus $124,123 for contingency, for a total of
$704,588, be requested. Should that full amount be available, some or all of the contingency may remain upon
completion of the project. It is our understanding that potential additional funding may be capped at $500,000. If so, this
will leave a deficit of $80,465 plus whatever portion of the work is set aside to provide a contingency amount for the
project.
