PROJECT SUMMARY: The applicant proposes the replacement of the existing bulkhead, boardwalk, and breakwater. 9. NARRATIVE DESCRIPTION: The proposed development site is listed as Marshes Light at 201 Fernando Street; the project area is adjacent Fernando and Compton Street in the Town of Manteo and Shallowbag Bay. The property is listed under the names of ML Marina LLC & ML Masters LLC, and the parcels total 14.5 acres. The properties are currently developed with a marina with 60 slips, piers, boat slips, finger piers, breakwater, bulkhead, boardwalk, condos, a net shed, and parking. Vegetation on the site includes the Coastal wetland (CW) plant Black needle rush (Juncus roemerianus), 404 wetland plant Phragmites, Atlantic Cedar, Pine trees, and indigenous grass. The shoreline is —3,125 linear feet (lft) and is bulkheaded except for locations where CW and 404 vegetation exists. The elevation of the shoreline ranges from 3 to 5 feet above Normal Water Level (NWL). The riparian property to the north is marsh land and is developed with a boardwalk and platforms. The riparian property to the south is developed with a single-family residence, pier, slips and boat ramp. Major Permit #124-05 was originally issued to Harry Schiffman in 2005 for maintenance excavation, bulkhead/retaining wall, gazebo, and the development of single-family residential structures and condominium complexes. The permit was transferred in 2006 to Marshes Light, LLC. Minor modifications to the permit included increasing the boardwalk and the addition of the Harbor Masters Shed. A major modification was issued in 2009 to include the expansion of the marina and addition of fuel services. The permit was transferred to ML Marina LLC & ML Masters LLC in 2020. Another major modification was issued in 2021 for a marina expansion to include 93 additional boat slips and a breakwater; this development has not taken place to date. The water classification for adjacent waterbody is SC: Aquatic Life, Secondary Contact Recreation, Tidal Salt Water. It is designated as Coastal Waters and is in the Pasquotank River Basin. The water depths along the project area range from -2.46' to-3.3.64' NWL. The project area is in a secondary primary nursery area and is closed to shellfishing. 10. PROJECT DESCRIPTION: The existing 518 lft of wooden bulkhead is proposed to be replaced with a vinyl bulkhead. The alignment will be placed an average distance of 2' waterward of NWL, with a maximum distance of 4' waterward of NWL. The current 528-1ft boardwalk is partially sited over water and partially upland of the bulkhead over land. The replacement 10-foot wide boardwalk will be proposed with 481ft constructed over water and the balance of 4801ft constructed over land. An existing 441ft breakwater to the north of the existing bulkhead is proposed to be replaced with slotted, vinyl sheeting. ANTICIPATED IMPACTS: Construction of the replacement bulkhead and breakwater will fill and disturb 1,576 sf of Shallow Bottom Habitat in the EW/PTA Areas. The replacement boardwalk constructed over water will shade 480 sf of Open Water Habitat in the EW/PTA Areas. The replacement boardwalk constructed over land will shade 4,800 sf of High Ground habitat in the CS Areas. The upland disturbance associated with the tiebacks/fill for the replacement bulkhead will impact—10,360 sf of High Ground habitat in the CS Areas. PROJECT DESCRIPTION: The existing 5181ft of wooden bulkhead is proposed to be replaced with a vinyl bulkhead. There are three areas on the southern end that have experienced erosion landward of the existing bulkhead, resulting in a NWL measurement of 4' to 8' landward of the derelict wall. The new alignment will be placed a maximum distance of 2' waterward of the current bulkhead. The current 528-1ft boardwalk is partially sited over water and partially upland of the bulkhead over land. The replacement 10-foot wide boardwalk will be proposed with 481ft constructed over water and the balance of 4801ft constructed over land. Two sets of stairs are proposed to access the new boardwalk. Existing Land Uses: The existing land use is a mixed use development consisting of residential, commercial, and marina facilities. Adjacent properties include similar uses. Existing Wastewater Treatment/Disposal: This served by the town of Manteo central wastewater system. Solid Waste/Fish Offal/Trash Disposal: On -site dumpsters and roll -out cans. Use and Daily Operations of the Project When Complete Proposed Development Purpose: The proposed development includes the replacement of a portion of the existing bulkhead, boardwalk and a section of breakwater. This is needed due to deteriorating conditions of the existing structures that are in need of replacement. The owners evaluated repair versus replacement and it was determined it was prudent to replace in this situation. Buildings/Facilities/Units/Structures: Replacement of the existing bulkhead, boardwalk and a section of breakwater. Use & Daily Operations: The daily use of this section of the property will continue as a mixed use community and marina with parking and pedestrian access. Construction Methodology & Equipment: Construction equipment will consist of dump trucks, excavator, skid steers, vibratory hammer, and hand tools. Development Activities Narrative Specifics: The proposed development includes the replacement of the existing bulkhead, boardwalk and a section of breakwater all in need of replacement. No new upland development or impervious surfaces are proposed. Application Narrative: The proposed project involves the replacement of an existing section of boardwalk, bulkhead, and breakwater at Marshes Light in Manteo, Dare County, North Carolina. Marshes Light (Site) is located along the shoreline of Shallowbag Bay, and bound by Fernando Street to the north, Grenville Street to the south and the College of the Albemarle Campus to the west. The existing uplands on Site were permitted to be developed under CAMA Major Permit #124-05. CAMA Permit 124-05 was modified in 2009 to permit the expansion of the existing 60 slip marina. The permitted expansion included an additional 98 wet slips with a wave attenuator, sewer pump out, fuel tanks and other marina amenities etc. CAMA Permit 124-05 was transferred to ML Marina, LLC in 2017. The permit was renewed for several years while repair work was on going and the permit expired in 2019. ML Marina, LLC (SAGA Construction) is now ML Masters, LLC. These two entities are managed by the same people, but both oversee Marshes Light. The marina has existed in its current location and configuration since the late 1970's. In 2020, a Major Modification was issued for the expansion of the existing marina to 153 slips and the addition of a wave attenuation breakwater system. This proposed modification is for the replacement of an existing boardwalk, bulkhead, and breakwater on the northern side of the property. This modification does not include any changes to the permitted marina. The existing boardwalk at the northern end of the property that was permitted in the original CAMA Major, is in need of replacement to due age and normal wear and tear. A new 10ft wide by 528 LF boardwalk is proposed within the a similar footprint of the existing. This boardwalk is situated over the top of a timber bulkhead that is also in need of replacement. Currently 1,522 sf of the existing boardwalk is situated over water, and 3,711 sf is situated over land. The new proposed boardwalk would be mostly situated over land with only the section of boardwalk at the breakwater (442 sf) and a small section at the southern end of the boardwalk (40 SF) to continue to be over water. All of the rest of the boardwalk (4,798 sf) would be over land based on the new bulkhead alignment and fill. This modification also includes the construction of a new bulkhead and wingwalls approximately 2ft waterward of the existing bulkhead and 518ft in length. The new bulkhead alignment would require 1,532 sf of material to be placed below NWL for backfill and filling in washout areas. The new boardwalk would follow the alignment of the new bulkhead, allowing the majority to be over land. In addition to the new boardwalk and bulkhead, a 44 LF section of the existing breakwater to the north of the existing bulkhead is proposed to be replaced. This new section of breakwater would be placed landward of the existing and would be constructed of slotted vinyl sheeting instead of timber. All proposed work and existing features are shown on the attached CAMA Major Plan. The proposed project involves the replacement of an existing section of boardwalk, bulkhead, and breakwater located along the shoreline of Shallowbag Bay. The existing development and marina on site were permitted under CAMA Major Permit #124-05. This modification does not include any changes to the permitted marina or upland development. This proposed modification is for the replacement of an existing boardwalk, bulkhead, and breakwater on the northern side of the property. The existing boardwalk at the northern end of the property was permitted in the original CAMA Major, is in need of replacement to due age and normal wear and tear. A new 10ft wide by 528 LF boardwalk is proposed within the a similar footprint of the existing. This boardwalk is situated over the top of a timber bulkhead that is also in need of replacement. This modification would include the construction of a new bulkhead and wingwalls approximately 2ft waterward of the existing bulkhead and 518ft in length. The new boardwalk would follow the alignment of the new bulkhead. In addition to the new boardwalk and bulkhead, a 44 LF section of the existing breakwater to the north of the existing bulkhead is proposed to be replaced. This new section of breakwater would be placed landward of the existing and would be constructed of slotted vinyl sheeting instead of timber.
