(CDM Smith) is pleased to submit this pre - construction notification (PCN) and supplemental information concerning the Stagecoach Road Force Main Sewer Improvements project in Durham County, North Carolina (Figure 1). We are requesting concurrence from the U.S. Army Corps of Engineers (USACE) that the activities proposed below may proceed under a Nationwide Permit 58 and concurrence from the NC Division of Water Resources (NCDWR) that the activities proposed below may proceed under an Individual Water Quality Certification. We are also requesting a riparian buffer authorization in the Jordan Lake Watershed. A NCDWR pre -filing meeting request was submitted on June 16th, 2023 (submittal e- mail attached). Project Purpose and Need Durham is one of the most rapidly growing cities in North Carolina. Significant development in the Stagecoach Basin has resulted in increased wastewater flow to the Stagecoach Lift Station (LS) and Southpoint LS (Figure 2). The purpose of the project is to improve the infrastructure to manage the additional flow and continue to provide wastewater treatment for the City's residents. City of Durham - Stagecoach Road Force Main Sewer Improvements Pre -Construction Notification October 12th, 2023 Page 2 Project Description The Stagecoach Road Force Main Project will redirect wastewater flow to the South Durham Water Reclamation Facility (SDWRF). The Stagecoach LS and Southpoint LS will both send wastewater through new force mains to the SDWRF. The Stagecoach Road Force Main Sewer Improvements project includes the following components: ■ Installation of approximately 8,645 linear feet of 24-inch force main between the Stagecoach Road LS and the SDWRF. ■ Installation of approximately 3,275 linear feet of 8-inch force main between the Southpoint Plantation LS and the SDWRF. ■ Temporary facilities (including bypass pumping and temporary water) as required to maintain service during construction and connection to the new facilities. ■ Grading, paving, erosion control, site cleanup, seeding, and testing of all installed sewer infrastructure. There are approximately 11.3 acres of ground disturbance planned. Construction for the force mains installation will include work along a new 30-foot wide sewer right-of-way, and existing sewer and NCDOT right-of-way. More details regarding the proposed work are shown on the impact plan sheets. The construction period is estimated to be approximately 18 months, with temporary wetland, stream and buffer impacts in place for less than 90 days each. Each individual temporary impact would be limited to a very short time, just enough to install or replace the gravity sewer lines. Standard construction and pipe installation equipment such as cranes, excavators, dump trucks, and similar vehicles would be used for the project. Proper erosion and sedimentation control measures would be employed throughout the project. Jurisdictional Features Mr. Jason Hales of CDM Smith conducted a wetland delineation within the approximately 76-acre Project Study Area (PSA) on June 161h and 17th, and September 2nd, 2021. Figures 3 through 6 show the USGS topographic, USDA Soils survey, NWI wetland, and preliminary wetland boundary mapping for the site. Seven wetland areas, three perennial streams, and three intermittent streams were identified during the delineation (Figure 6). Table 1 provides a summary of the delineated features within the PSA. A preliminary jurisdictional determination (PJD) request for the delineation was submitted to the USACE on May 4th, 2022. A PJD concurrence e-mail verifying the delineation was received from the USACE on July 7th, 2022 (attached). A buffer determination request for the project area was submitted to NCDWR on March 20th, 2023 and a buffer determination letter was received from NCDWR on April 181h, 2023 (attached). The proposed wetland, stream and buffer impacts are described below, summarized in Tables 2, 3 and 4 below, and shown on the attached impacts plan sheets. Wetland Impacts There are 0.975 acres of proposed permanent wetlands impacts for land clearing, conversion, and force main installation along a new maintained 30-foot wide sewer right-of-way between the Stagecoach LS and the SDWRF. (Impacts plan sheet C-102, C-103, C-104, C-105, C-106, C-107 and C- 108), Impact numbers W1, W2, W3 and W5). These areas will be cleared of vegetation, used for the installation of the 24-inch force main, and maintained for future access. There are a total of 0.975 acres of proposed permanent wetland impacts. There are 1.109 acres of proposed temporary wetlands impacts for construction access and force main installation between the Stagecoach LS and the SDWRF. (Impacts plan sheets C-104, C-105, C- 106, C-107 and C-108, Impact numbers W4 and W6). These areas will be used for the installation of the 24-inch force main and maintained for future access. There are a total of 1.109 acres of proposed temporary wetland impacts. There are a total of 2.084 acres of proposed permanent and temporary wetland impacts. Impacted wetland areas will be seeded with native wetland herbaceous species and then be maintained as herbaceous wetlands for future access. Table 2. This area will be used for the installation of the 24-inch force main. The proposed construction corridor across the stream is 40-foot wide with a planned 30-foot wide permanent maintained right-of-way. There are a total of 67-linear feet of proposed temporary stream impacts. The stream bed in areas of proposed temporary stream impacts will be restored to pre -project elevations and widths using natural stream bed material. Temporarily impacted stream banks will be restored through regrading, seeding and woven coir fiber mat, and then be maintained for future access. All work in or adjacent to streams will be conducted so that the flowing stream does not come in contact with the disturbed area (typical detail shown on sheet CD-8). There are a total of 153-square feet of proposed permanent buffer impacts. The planned limits of disturbance for construction and permanent maintenance corridors were reduced following the wetland delineation to reduce potential impacts. The proposed impact amounts would be a maximum of potential impacts to the features. Land clearing will be the minimum necessary to install the infrastructure. In wetlands, across stream channels and in riparian buffers, stumps will be grubbed only as needed to install the infrastructure, and remaining stumps will be cut off at grade level. The general stripping of topsoil within wetlands along the construction corridor will be avoided. Heavy equipment working in wetlands will be placed on mats to minimize soil disturbance and compaction. Work in wetlands will be limited to only what is necessary to install the infrastructure. Impacted wetland areas will be seeded with native wetland herbaceous species and then be maintained as herbaceous wetlands for future access. All work in or adjacent to streams will be conducted so that the flowing stream does not come in contact with the disturbed area (typical detail shown on sheet CD-8). Temporarily impacted stream banks will be restored through regrading, seeding and woven coir fiber mat, and then be maintained for future access. The stream bed in areas of proposed temporary stream impacts will be restored to pre -project elevations and widths using natural stream bed material. There will be no change in pre -construction contours of waters of the United States in temporarily impacted areas. Erosion control matting that incorporates plastic mesh and/or plastic twine will not be used along stream banks or within wetlands. All mechanized equipment operated near City of Durham - Stagecoach Road Force Main Sewer Improvements Pre -Construction Notification October 12th, 2023 Page 7 surface waters shall be inspected and maintained regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other toxic materials. Construction shall be staged in order to minimize the exposure of equipment to surface waters to the maximum extent practicable. Mitigation Mitigation is proposed for 0.975 acres of wetland conversion associated with the planned new maintained 30-foot wide sewer right-of-way between the Stagecoach LS and the SDWRF. Wetland credits would be purchased from a private bank in the Cape Fear 03030002 River Basin. A Statement of Availability was received from Wildlands Holdings VI, LLC on August 281h, 2023 (attached) for 1.00 acres of wetland mitigation credits from the Cape Fear 02 Umbrella Mitigation Bank: Flat Rock Mitigation Site. Threatened and Endangered Species A biological assessment for potential effects to endangered or threatened species was submitted to the US Fish and Wildlife Service (USFWS) Raleigh office for review on February 281h, 2023 (attached). The biological assessment included a field reconnaissance survey for potential threatened and endangered species and habitats conducted in the project area June 161h and September 2nd, 2021. As of the date of this request a response has not been received from the USFWS. The biological assessment recommended that the proposed action is not likely to adversely affect any federally listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing at these sites. Historical and Cultural Resources An environmental review request for the project was submitted on February 27th, 2023 to the North Carolina State Historic Preservation Office (NC HPO). A response was received on May 22nd, 2023 from NC HPO following their review of the project. They are aware of no historic resources which would be affected by the proposed project (response e-mail attached). We look forward to working with you on the project. This BA evaluates the potential effects of the proposed project on species that are listed under Section 7 of the ESA. A field survey for potential threatened and endangered species was conducted in the project area on June 16th, 2021 and September 2nd, 2021. Site Description The project is located in Durham County, North Carolina (Figures 1 and 2). The project area is approximately 76 acres and consists of the South Durham Water Reclamation Facility (SDWRF), existing sewer lines and maintained easements, a Dominion Energy gas line and maintained easement, paved roadways, electric utility lines, residences, wooded areas, wetlands, and streams (representative photographs attached). Figure 3 shows the USGS topographic map for the project area. Project Description Southeast Farrington and Stagecoach Road Force Main Sewer Improvements Project includes the following: ■ 9700' of 24" force main from Stagecoach Lift Station to South Durham WRF ■ 5600' of 8" force main from Southpoint Plantation Lift Station to South Durham WRF Standard construction and pipe installation equipment such as cranes, excavators, dump trucks, and similar vehicles will be used for the project. Proper erosion and sedimentation control measures will be employed throughout the project. All work will be done in the dry. Page 2 Federally Protected Resources A list of threatened and endangered species that may occur within the boundary of the proposed project and/or may be affected by the proposed project was provided for the survey area by the U.S. Fish and Wildlife Service (USFWS) through the Information for Planning and Consultation (IPaC) system on February 17th, 2023 (attached). A field survey for the USFWS federally protected threatened and endangered species on the list was conducted by CDM Smith within the project area on June 161h, 2021 and September 2nd, 2021. Species that are endangered, threatened or candidate species on the list provided for the survey area are summarized in Table 1 below. Table 1. Mammals Tricolored bat — Proposed Endangered USFWS Recommended Survey Window: May 1 to September 15 Species Description: The tricolored bat is distinguished by its unique tricolored fur and often appears yellowish to nearly orange. Individual hairs are tricolored: dark gray at the base, yellowish brown in the middle, and brown or reddish brown at the tip. It is the smallest bat species found in the eastern and midwestern United States. Individuals have a forearm length of 31.4 to 34.1 mm (1.24 to 1.34 in) and weigh 4.6 to 7.9 g (0.16 to 0.28 oz). Its forearms are reddish, contrasting sharply with the black membranes of its wings. Its wingspan is 21 to 26 cm (8.3 to 10.2 in). Page 3 Habitat: During the summer tricolored bats roost among leaf clusters of live or recently dead deciduous hardwood trees. Tricolored bats will also roost in Spanish moss and have been observed roosting during summer among pine needles, eastern red cedar, and occasionally human structures. During the winter, tricolored bats hibernate in caves and mines. It forages with slow, erratic flight in areas near water or forest edges. Effects: Potential suitable summer roosting habitat for the tricolored bat is present in the project area. Most of the planned improvements are within existing maintained easements or road right-of- way. Tree clearing will be necessary in some areas of new sewer alignment. Potential suitable foraging habitat for the tricolored bat occurs in the project area adjacent to New Hope Creek, some smaller unnamed tributaries, and along the forest edges. Any removal of mature trees would occur between October 15th to March 31st. The proposed project will have no effect on this species. Bioloeical Conclusion: no effect Clams Atlantic Pigtoe USFWS Recommended Survey Window: year round Species Description: The shell of the Atlantic pigtoe is a chunky, rhombus shape, like that of a pig's hoof/toe. Individuals from headwater areas are more elongate. There is a distinct posterior ridge. The outer surface of the shell is yellow to dark brown and parchment -like, while the inner layer is iridescent blue to salmon, white, or orange. Although larger specimens exist, the Atlantic pigtoe rarely exceeds 2-inches in length. Young individuals may have greenish rays across the entire shell surface. When collected fresh, the interior surface (nacre) in the shell tends to be salmon colored and sometimes iridescent. Atlantic pigtoe has interlocking hinge "teeth" on the inside of the shell to help keep the two valves in proper alignment. Habitat: The Atlantic pigtoe has been found in multiple physiographic provinces, from the foothills of the Appalachian Mountains, through the Piedmont and into the Coastal Plain. The Atlantic pigtoe requires relatively fast waters with high quality riverine/large creek habitat. It is typically found in headwaters or rural watersheds. The preferred habitat of the Atlantic pigtoe is coarse sand and gravel at the downstream edge of riffles. It is less common in sand, cobble and mixtures of sand, silt and detritus. The Atlantic pigtoe requires fast flowing, well oxygenated streams and is restricted to fairly pristine habitats. Historically, the best populations existed in small creeks to larger rivers with excellent water quality, where flows were sufficient to maintain clean, silt -free substrates. The general pattern of its current distribution indicates that the species is currently limited to headwater areas of drainages and most populations are represented by few individuals. In North Carolina, aside from the Waccamaw River, it was once found in every Atlantic Slope river basin. Effects: The project area contains several intermittent and perennial stream features, which do not have potential habitat for Atlantic pigtoe. The intermittent streams and upper perennial streams Page 4 are not large enough and do not have suitable water quality to support Atlanic pigtoe. New Hope Creek in the project area is an impounded lower perennial stream within a large floodplain. It has a very sedimentary environment without fast flowing, well oxygenated water, or riffles. Two open cut crossings are proposed across streams. One crossing is on an intermittent stream at the very upper most portion of its drainage. The other crossing is on New Hope Creek along the Dominion Energy gas line between the SDWRF and NC Highway 751. The North Carolina Natural Heritage Program (NCNHP) database does not show any elemental occurrences for this species in the project area or within 7-miles of the project area (Figure 4). All work within streams will be done in the dry and will be the minimum necessary to install the infrastructure. The proposed project will have no effect on this species. Biological Conclusion: no effect Insects Monarch butterfly USFWS Recommended Survey Window: August -December Species Description: Adult monarch butterflies are large and conspicuous, with bright orange wings surrounded by a black border and covered with black veins. The black border has a double row of white spots, present on the upper side of the wings. Adult monarchs are sexually dimorphic, with males having narrower wing venation and scent patches. The bright coloring of a monarch serves as a warning to predators that eating them can be toxic. During the breeding season, monarchs lay their eggs on their obligate milkweed host plant (primarily Asclepias spp.), and larvae emerge after two to five days. Larvae develop through five larval instars (intervals between molts) over a period of 9 to 18 days, feeding on milkweed and sequestering toxic chemicals (cardenolides) as a defense against predators. The larva then pupates into a chrysalis before emerging 6 to 14 days later as an adult butterfly. There are multiple generations of monarchs produced during the breeding season, with most adult butterflies living approximately two to five weeks; overwintering adults enter into reproductive diapause (suspended reproduction) and live six to nine months. Habitat: The monarch butterfly occurs in migratory populations that breed in summer across North America. It occurs in a variety of habitats where it searches for its host plant milkweed. The species is widespread in the U.S., and in Southern Canada, with the overall range extending through Central America and the Caribbean to South America. Monarchs also occur in Hawaii, Australia, and several Pacific islands, as well as parts of Asia, Africa, and southern Europe. The population size fluctuates in much of its range but remains in the tens of millions in North America. In North Carolina during the fall, winter, and early spring, they can be found basking or roosting on evergreen trees and shrubs. Effects: The monarch butterfly is a candidate species and not yet listed or proposed for listing. There are generally no Section 7 requirements for candidate species. The proposed project will have no effect on this species. Page 5 Biological Conclusion: no effect Plants Michaux's sumac USFWS Recommended Survey Window: May to October Species Description: Michaux's sumac is a rhizomatous, densely hairy shrub, with erect stems from 1 to 3-feet in height. The compound leaves contain evenly serrated, oblong to lanceolate, acuminate leaflets. Most plants are unisexual; however, observations have revealed plants with both male and female flowers on one plant. The flowers are small, borne in a terminal, erect, dense cluster, and colored greenish yellow to white. Flowering usually occurs from June to July; while the fruit, a red drupe, is produced through the months of August to October. Habitat: Michaux's sumac, endemic to the inner Coastal Plain and lower Piedmont, grows in sandy or rocky, open, upland woods on acidic or circumneutral, well -drained sands or sandy loam soils. The species is also found on sandy or submesic loamy swales and depressions in the fall line Sandhills region as well as in openings along the rim of Carolina bays; maintained railroad, roadside, power line, and utility rights -of -way; areas where forest canopies have been opened up by blowdowns and/or storm damage; small wildlife food plots; abandoned building sites; under sparse to moderately dense pine or pine/hardwood canopies; and in and along edges of other artificially maintained clearings undergoing natural succession. In the central Piedmont, it occurs on clayey soils derived from mafic rocks. The plant is shade intolerant and, therefore, grows best where disturbance (e.g., mowing, clearing, grazing, periodic fire) maintains its open habitat. Effects: The project area contains maintained easements and roadway right-of-way with potential suitable habitat for Michaux's sumac. The NCNHP database does not show elemental occurrences for this species in the project area or within 9-miles of the project area (Figure 4). The closest current elemental occurrence is 11-miles from the project area. Michaux's sumac was not observed during the field survey. The proposed project action may affect, but is not likely to adversely affect this species. Biological Conclusion: may affect, but is not likely to adversely affect Smooth conef lower USFWS Recommended Survey Window: late May to October Species Description: Smooth coneflower is a rhizomatous perennial herb that grows up to 5-feet tall from a vertical root stock. The stems are smooth, with few leaves. The largest leaves are the basal leaves, which reach 8-inches in length and 3-inches in width, have long stems, and are elliptical to broadly lanceolate, tapering to the base, and smooth to slightly rough. Mid -stem leaves have shorter stems or no stems and are smaller in size than the basal leaves. The rays of the flowers Page 6 (petal -like structures) are light pink to purplish, usually drooping, and 2 to 3.2-inches long. Flower heads are usually solitary, with flowering occurring from May through July. Habitat: The habitat of smooth coneflower is open woods, cedar barrens, roadsides, clearcuts, dry limestone bluffs, and utility line right-of-way, usually on magnesium- and calcium -rich soils. Optimal sites are characterized by abundant sunlight and little competition in the herbaceous layer. Natural fires, as well as large herbivores, are part of the history of the vegetation in this species' range. Effects: The project area contains maintained easements and roadway right-of-way with potential suitable habitat for smooth coneflower. The NCNHP database does not show any elemental occurrences for this species in the project area or within 2-miles of the project area (Figure 4). The closest current elemental occurrence is 11-miles from the project area. Smooth coneflower was not observed during the site survey. The proposed project action may affect, but is not likely to adversely affect this species. Biological Conclusion: may affect, but is not likely to adversely affect Critical Habitat There is no critical habitat within the boundary of the proposed project area (IPaC report dated February 17th, 2023). Page 7 Conclusions and Determination Potential habitat for Tricolored bat, Michaux's sumac and smooth coneflower is present in the project area. The proposed project is designed primarily within existing maintained easements and road right-of-way, and the minimum necessary to perform the improvements. Any removal of mature trees would occur between October 15th to March 31st. Based on the minimal planned impacts, the potential benefits of continued disturbance and maintenance of the easements, and no observations of the listed species during the field survey, the proposed action may affect, but is not likely to adversely affect Michaux's sumac and smooth coneflower. Probability of Presence (■) Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your project overlaps during a particular week of the year. (A year is represented as 12 4-week months.) A taller bar indicates a higher probability of species presence. The survey effort (see below) can be used to establish a level of confidence in the presence score. One can have higher confidence in the presence score if the corresponding survey effort is also high. 02/17/2023 3 How is the probability of presence score calculated? The calculation is done in three steps: The probability of presence for each week is calculated as the number of survey events in the week where the species was detected divided by the total number of survey events for that week. For example, if in week 12 there were 20 survey events and the Spotted Towhee was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is 0.25. 2. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any week of the year. The relative probability of presence on week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2. 3. The relative probability of presence calculated in the previous step undergoes a statistical conversion so that all possible values fall between 0 and 10, inclusive. This is the probability of presence score. Breeding Season( ) Yellow bars denote a very liberal estimate of the time -frame inside which the bird breeds across its entire range. If there are no yellow bars shown for a bird, it does not breed in your project area. Survey Effort (1) Vertical black lines superimposed on probability of presence bars indicate the number of surveys performed for that species in the 10km grid cell(s) your project area overlaps. The number of surveys is expressed as a range, for example, 33 to 64 surveys. No Data (—) A week is marked as having no data if there were no survey events for that week. Survey Timeframe Surveys from only the last 10 years are used in order to ensure delivery of currently relevant information. When birds may be breeding in the area, identifying the locations of any active nests and avoiding their destruction is a very helpful impact minimization measure. What does IPaC use to generate the list of migratory birds that potentially occur in my specified location? The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern (BCQ and other species that may warrant special attention in your project location. The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding, and citizen science datasets and is queried and filtered to return a list of those birds reported as occurring in the 10km grid cell(s) which your project intersects, and that have been identified as warranting special attention because they are a BCC species in that area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to offshore activities or development. Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not representative of all birds that may occur in your project area. What does IPaC use to generate the probability of presence graphs for the migratory birds potentially occurring in my specified location? The probability of presence graphs associated with your migratory bird list are based on data provided by the Avian Knowledge Network (AKN). This data is derived from a growing collection of survey, banding, and citizen science datasets. Probability of presence data is continuously being updated as new and better information becomes available. To learn more about how the probability of presence graphs are produced and how to interpret them, go the Probability of Presence Summary and then click on the "Tell me about these graphs" link. How do I know if a bird is breeding, wintering or migrating in my area? To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the profiles provided for each bird in your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 02/17/2023 2. 'BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from certain types of development or activities (e.g. offshore energy development or longline fishing). Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. Details about birds that are potentially affected by offshore projects For additional details about the relative occurrence and abundance of both individual bird species and groups of bird species within your project area off the Atlantic Coast, please visit the Northeast Ocean Data Portal. The Portal also offers data and information about other taxa besides birds that may be helpful to you in your project review. Alternately, you may download the bird model results files underlying the portal maps through the NOAA NCCOS Integrative Statistical Modeling and Predictive Mapping of Marine Bird Distributions and Abundance on the Atlantic Outer Continental Shelf project webpage. Bird tracking data can also provide additional details about occurrence and habitat use throughout the year, including migration. Models relying on survey data may not include this information. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be there, and if they might be breeding (which means nests might be present).
