Dear Ms. Ingham:
This letter is in reference to the Town of Holly Springs' request, received September 22, 2023, for a bypass
around the uncompleted pump station permitted through the fast track sewer extension permit number
WQ0034579. As stated in your letter and the supporting documentation provided, construction delays have
prevented the completion of construction and final certification of the pump station. Other aspects of the
permitted infrastructure are in place and certified. Due to the schedule for construction of the industrial
facility, there is an eminent need to transfer non process wastewater related to construction and
preparation activities at the site to the Holly Springs wastewater treatment plant.
The Division of Water Resources will allow the bypass, under the following conditions:
1) Wastewater transferred through the temporary bypass shall only include wastewater related to
construction and preparation activities (non -process wastewater). The Town, in coordination with Amgen
and the project manager, shall insure that such wastewater shall not compromise the material of the bypass
piping (currently specified for domestic strength wastewater).
2) The Town of Holly Springs shall have an agreement in place between itself and the contractor explicitly
specifying the responsibilities of each. This includes designating an on -site representative (this may be the
contractor or a Town staff member) to coordinate emergency response and notification, and to report to an
incident commander, should such need arise.
3) The Town of Holly Springs shall inspect the bypass site daily (this shall be independent and in addition to
the contractor).

4) As provided with the supplemental information, the pumping system for the bypass shall have dual
pumps with visible and auditory alarm system and telemetry (including telemetry for notification of low fuel
levels for the bypass pumps).
5) This bypass shall be effective through receipt in this office of the final certification for Fast Track Sewer
Permit WQ0034579 Modification issued August 3, 2022 or December 31, 2023, whichever comes first.
Please be advised that any overflow or spill from this bypass may constitute a violation of North Carolina
General Statute §143-215.1 and subject the permittee to enforcement action in accordance with North
Carolina General Statute §143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be
assessed as required by North Carolina General Statute §143-215.1.
