Description of projects area and activity: This verification authorizes the permanent discharge of fill material into 0.054-acre (128 LF)of stream channel(of which 0.026 acre 174LF1 is no-permanent-loss stream channel)and the permanent conversion of 0.115-acre riparian non-riverine wetland to emergent shrub/scrub and the temporary discharge of fill material into 0.016- acre of riparian non-riverine wetland and 0.038 acre(126 LF)of stream for the construction,access,and infrastructure of the Cub Creek&Sandy Ridge residential development. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order,a restoration order,a Class I administrative penalty,and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify,suspend or revoke the authorization. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. b. Suitable habitat for tricolored bat (Perimyotis subflavus) may be present at the site. On September 14, 2022, the United States Fish and Wildlife Service (USFWS)published a proposal in the Federal Register to list the tricolored bat as endangered under the Endangered Species Act(ESA). The permittee understands and agrees that all work associated with the clearing and removal of trees, and removal or modification of culverts must be completed prior to September 15, 2023. Work associated with the aforementioned activities not completed by September 15, 2023, must cease and the permittee must contact the Corps (Julia Tillery at 919.440.1951 or julia.a.tillery(a,usace.army.mil) to determine if additional coordination with the USFWS is required under Section 7 of the ESA prior to continuing work. c. Please note that this project is considered cumulative with all current and future phases of the Cub Creek& Sandy Ridge residential development with respect to compensatory mitigation and Nationwide Permit thresholds. As such, impacts permitted for this project (SAW-2018-02203) are considered cumulative with impacts proposed for any future phases. Current cumulative losses to waters of the US for the Cub Creek & Sandy Ridge single and complete project include 0.028 acre (54 LF) of stream channel.
