PROJECT SUMMARY: The applicant proposes to fill 482 sf of USACE 404 wetlands and install a bulkhead along the two property's shorelines. 9. NARRATIVE DESCRIPTION: The project is located at 183 and 185 Bayview Drive in Stumpy Point, Dare County. The properties are adjacent Stumpy Point Bay, which connects with the Pamlico Sound. Mr. and Mrs. Weber's property is a 19,000-sf lot with —91' of shoreline. The property is developed with a single-family residence and driveway, as well as —9' of bulkheading and return wall that encroached the property line when the adjacent property owner constructed their bulkhead. The upland vegetation consists of ornamental trees, shrubs, and indigenous grass; the shoreline consists of Phragmites, a Section 404 wetland. Ms. Doughtie's property is a 20,000-sf lot with —100' of shoreline. The property is developed with a vinyl bulkhead that ends approximately 12' short of the property line, and rock revetment along the east end of the shoreline. The upland vegetation consists of ornamental shrubs and indigenous grass; the vegetation between the revetment and bulkhead consists of the Coastal wetland plant Smooth cordgrass (Spartina alterniflora) and 404 Phragmites. Ms. Doughtie also owns 181 Bayview Drive, which is developed with a single-family residence, decking, driveways, and a bulkhead. There is no CAMA permit history on file for the Weber property. Nita Doughtie obtained GP86220 on 02/22/22 for a replacement vinyl bulkhead on 181 and a new bulkhead on 183 Bayview Drive. The previous owner of 181 Bayview Drive, Julian Toxey, had obtained GP58099 on 09/09/11 after Hurricane Irene for a replacement pier and platform. That permit verified that there was an existing wooden bulkhead onsite. The riparian property to the east is developed with a single-family residence, driveways, deck, walkway, pier, platform and boatlift. The riparian property to the west is developed with a single-family residence, decking, driveways, a walkway to the shoreline, and rock along the shoreline. The water classifications for Stumpy Point Bay are SA and HQW. The adjacent waterbodies are designated as Coastal Waters and are in the Pasquotank River Basin. The immediate project area is open to shellfish taking. 10. PROJECT DESCRIPTION: The applicants propose to fill a 482-sf area of 404 wetlands and construct 94 linear feet (lft) of vinyl bulkheading landward of Normal Water Level (NWL). The bulkhead will tie into each riparian property owner's existing bulkheads. 11. ANTICIPATED IMPACTS: The proposed bulkhead will result in the filling of 482 sf of 404 wetlands. Development Activities Narrative Specifics: The adjacent properties are bulkheaded with the bulkhead on the property to the east extending onto Lot 185 (Weber) and the bulkhead on the property to the west not reaching the property line of the Weber lot. To create an alignment which extends between the two existing bulkheads, the property owner of Lot 183 (Doughtie) is a co -applicant. Application Narrative: The applicant proposes to construct a bulkhead above NWL between two existing bulkheads. The adjacent property owner to the east (187 Bayview Drive) constructed a bulkhead which extended onto the Weber property (185 Bayview Dr.) and the property owner's bulkhead to the west (183 Bayview Dr) did not reach the property line. Thus, in order to complete the bulkhead alignment, the property owner to the west (Doughtie) became a co applicant. The need for the new bulkhead is to complete the shoreline protection in this area and prevent further encroachment of the sound waters on the Weber and Doughtie properties. The alignment will result in 482 sf of Section 404 wetlands could not be avoided in order to create a straight alignment between the two existing bulkheads. Only the area of wetlands landward of the proposed alignment will be impacted. Preliminary Determination ® There appear to be wetlands on the above described project area/property, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The wetlands have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable.
