DEED OF EASEMENT FOR STORMWATER
THIS DEED OF EASEMENT, made this 2Zday of IjQtaint 20Z y and
between NP I85 COMMERCE CENTER INDUSTRIAL, LLC ("Property Owners") and
the CITY OF SALISBURY, a North Carolina municipal corporation ("City").
WITNESSETH:
WHEREAS, the Property Owners are the owners of certain property located in Rowan
County, North Carolina, identified as Rowan County Tax Parcel ID 409-022 and further
described in Deed Book 1383, Page 747 of the Rowan County Registry (the "Property");
WHEREAS, the City desires to acquire and the Property Owners desire to convey to
the City a permanent non-exclusive Stormwater Easement;
NOW, THEREFORE, for and in consideration of the sum of Ten Dollars ($10.00) and
other valuable consideration to it in hand paid, the receipt and sufficiency of which are hereby
acknowledged, the Property Owner does hereby convey unto the City, its successors and
assigns, a permanent, non-exclusive Stormwater Easement, for the purpose of construction
maintaining, and operating an underground water line, which is shown on Exhibit A
attached hereto and is more particularly described in Exhibit B attached hereto.
Exhibit C atatched to referenc the Operation & Maintenance Agreement.
All rights, title and privileges herein granted and all benefits and burden shall run
with the land and be binding upon and inure to the benefit of the parties, their respective
heirs, personal representatives, successors and assigns.
TO HAVE AND TO HOLD the aforesaid easements and all privileges and
appurtenances thereunto belonging to the City, its successors and assigns, for the uses and
purposes herein described.
And the Property Owners do convenant that they are seized of the premises in fee
simple and have the right to convey the easement rights to the easement area contained
herein, that they will warrant and defend the said title to the same against the lawful claims
of all persons whomever,except for those covenants, conditions, and rights currently existing
in and to the easement area, if any.

Wet Pond Maintenance Requirements
Important operation and maintenance procedures:
Immediately after the wet detention basin is established, the plants on the vegetated shelf and
- perimeter of the basin should be watered twice weekly if needed, until the plants become
established (commonly six weeks).
No portion of the wet pond should be fertilized after the initial fertilization that is required to establish-
the plants on the vegetated shelf.
_ Stable groundcover will be maintained in the drainage area to reduce the sediment load to the wet
pond.
If the pond must be drained for an emergency or to perform maintenance, the flushing of sediment
- through the emergency drain will be minimized as much as possible.
At least once annually, a dam safety expert will inspect the embankment. Any problems that are
- found will be repaired immediately.
The measuring device used to determine the sediment elevation shall be such that it will give an
accurate depth reading and not readily penetrate into accumulated sediments.
After the wet pond is established, it will be inspected quarterly and within 24 hours after every storm event greater
than 1.0 inches (or 1.5 inches if in a Coastal County). Records of operation and maintenance shall be kept in a
known set location and shall be available upon request.
Inspection activities shall be performed as follows. Any problems that are found shall be repaired immediately.
