This letter is a response to your request for additional information regarding the PCN we submitted
earlier in the year for the Bob's Gun Shop project, proposed for a parcel located on Currituck
Commons Drive, in Moyock, NC; your comments were received via email on July 27, 2023. These
responses are intended to provide additional information to complete our PCN for the project.
Item 1; provide a signed Agent Authorization. A signed agent authorization form is attached.
Item 2, appears to be asking for additional information regarding avoidance and minimization in
the project planning and intended execution, and for a valid mitigation plan. We offer the
following additional information regarding avoidance, minimization, and mitigation:
Avoidance. The site plan as currently provided (which is the second site plan for the site)
compresses the building and associated parking areas against the north-eastern portion of the
parcel; by doing so, the forested wetlands along the northwestern and western portions of the site
are largely avoided except for a two small areas. Most of the impacted wetlands occur in the center
of the site; these wetlands extend through the center of the site and any site development would be
difficult without disturbing this area. Neither the northern upland portion nor the southern upland
portion are sufficiently sized to allow for the proposed development, and access to the southern
larger upland area would require access through the central wetlands. The central wetland area
consists mostly of emergent wetlands, and are believed to be of fairly recent origin, largely created
through landfilling on the northern and southern portions of the site; fill material was identified in
both of these areas during our site investigation. The fill source is likely from the excavation of
the adjacent borrow pit to the south, and the roadway and other development to the north. The
central wetland area was not filled, and likely surface runoff from the east filled this area resulting
in the emergent wetland observed. The forested wetlands on the western and northwestern portions
of the site also did not receive significant fill soils. These forested wetlands are contiguous with

the ditch just to the west, and to additional forested lands to the west beyond the ditch. The ditch
typically exhibits mean high water.
The site plan as shown is for a very compact development, with the building a rectangle, with
closely adjacent parking areas to the east and north of the structure. An access lane from Moyock
Commons Drive is short and the whole development is compressed in the northeastern portion of
the parcel. The current site plan eliminates the originally planned turn -around area to the south of
the building (original site layout attached. Also, the large drainfield originally shown to the south
of the structure occupying much of the southern portion of the parcel has been eliminated, as the
proposed facility will tie into local sewage structures.
Minimization. As noted, the construction design minimizes impacts to the higher value apparently
long established forested wetlands along the western and northwestern portions of the parcel.
Construction methods as shown on the previously submitted site plans will utilize wire mesh
supported sediment fencing to visually and physically limit construction traffic from encroachment
into forested wetlands. Sediment control measures will be utilized to minimize the outfall of silt
and soil towards wetlands and towards the ditch along the western side of the site. While provision
is shown in the current plans for expansion by the addition of one range (previous plans showed
provision for 2 ranges to be added in the future) the wetland impacts from this proposed future
expansion are already accounted for in this plan. Any other expansion will take place toward the
southern residual portion of the site which consists largely of uplands.
Mitigation. Through careful site planning, wetland impacts have been kept below % of an acre
(20,899 sq.ft., or 0.48 acres), including a small amount of temporary and all permanent wetland
impacts. We propose utilizing the RES Pasquotank 05 Stream and Wetland Umbrella Mitigation
Bank or equivalent for mitigation of wetland impacts. Attached is a Statement of Availability
dated 17 August 2023 for 0.97 mitigation credits (assuming a 2:1 mitigation ratio) from this bank
(Statement of Availability letter attached).

Dear Mr. Balsley:
The following price quote is given in reply to your request for the purchase of 0.96 Non-Riparian/Riparian wetland
mitigation credits HUC Code 03010205 from The Great Dismal Swamp Restoration Bank - Timberlake Farm. These
credits are currently available from our Timberlake Mitigation Bank.
The cost will be Thirty -Three Thousand, Six Hundred Dollars ($ 33,600.00). This quote will expire on December 31,
2023 You will need to submit to the USCOE the necessary application for said mitigation, and receive USCOE
permission to furnish said required credits from our Timberlake bank.
To complete this transaction, we will require payment in full. Once payment is received, the credit sale will be
