State Permit # 42-20 was originally issued to the Town of Ocean Isle Beach on April 9, 2020, for maintenance excavation within the "natural" canals and associated entrance canals in Ocean Isle Beach. State Permit #42-20 was modified on November 21, 2022 to include the maintenance excavation of the "concrete" canals, feeder canals, and associated entrance canals. State Permit # 42-20 is set to expire on November 21, 2027. The applicant is requesting a minor modification to State Permit # 42-20 to change the methodology from hydraulic excavation to bucket -to -barge excavation exclusively within the 7-head" portions of the 13 concrete canals due to maneuverability issues associated with the hydraulic dredge equipment. The applicant was able to hydraulicly remove approximatley 30,769 CY of material within the concrete canals during the 2022-2023 maintenance dredging season. However, according to the applicant, material within the 7-heads" of the concrete canals could not be sufficiently removed due to equipment restrictions within the narrow canals and encroaching docks and boatlifts. As proposed, the remainder of the 2022-2023 maintenance dredging project would use bucket -to -barge excavation to remove approximately 3,322 CY of material from the 1-heads' of concrete canals # 1-13. As proposed, the spoils would be offloaded directly into dump trucks at the north end of Lee Street and transported to a previously authorized spoil site located at 5790 Old Georgetown Rd, Shallotte, NC. The applicant proposes to work within the previously permitted footprint and permitted depth of -6.O' MLW with -1.0' over -depth allowance. The applicant has submitted a check (check No. 501058) in the amount of $100 for the modification. As proposed, this office has no objection to the proposed project modification as long as there are no objections from other agencies to this proposal. It appears that the project continues to be CONSISTENT with the use standards set forth in NCAC 07H .O2O8(b)(6). These shallow -draft canals provide boating access for the adjacent property owners, allowing easy access to the adjacent AIWW and the Atlantic Ocean for purposes such as fishing, recreation and navigation. These "Concrete" canals have shoaled since their initial maintenance dredging as well as since the last maintenance dredging of these canals was performed in 2014/2015 under CAMA Major Permit #158- 08, which had an extended expiration date of March 4, 2015. Over the last 7 years since the previous dredge cycle, moderate shoaling has occurred due to the low tidal flow within the canals along with some surface runoff, resulting in inadequate draft depths in areas along these canals. This project proposes to accomplish maintenance dredging in these canals in the same footprint of the previously permitted dredging events but with an additional 1-foot for over -depth dredging allowance below the project depth, which only the most previous project had. PROJECT DESCRIPTION Approximately 30,769 CY of material was excavated and pumped to the US Army Corps of Engineers Disposal Area No. DA303, located at the end of Lee Street, Ocean Isle Beach, NC, located approximately 1/2 mile east of the Odell Williamson Bridge along the AIWW, at the end of Lee Street. (Latitude: 33*53' 54.23"N; Longitude: 78°24' 58.76" W) during the 2022-2023 maintenance dredging using a hydraulic pipeline dredge. However, material within the tee heads of the "concrete" canals could not be sufficiently removed due to the inability to maneuver the hydraulic dredge equipment within the tee heads due to docks, boatlifts, etc., which have been built and have encroached on the permitted design dredge footprint in many of the tee heads. The remainder of the maintenance dredging project proposes to use bucket -to -barge excavation to remove the remaining approximately 3,322 CY of material from the tee heads of the "concrete" canals, which will be transported via barge to an off-loading point at the end of Lee Street and then transported by dump truck off of the island to an upland, permitted, private disposal area in Brunswick County. We, on behalf of the Town, are requesting a Minor Modification to the current CAMA Major Permit #42- 20 in order to complete the current maintenance dredging of the "concrete" canals. ENVIRONMENTAL IMPACTS Since the remainder of the maintenance dredgingwill be performed during minimal activities of biological life, during the months as set forth in the current CAMA Major permit, it is believed that environmental impacts resulting from the dredging activities proposed in this project, in general, will be relatively minimal. All of the canal bottoms consist of sand, sediment and detritus and have had maintenance dredging performed in 2014-2015 as well as several earlier dates. With this maintenance project being directly correlated to previously approved CAMA Major Permits and permit requirements, as w performed within the dredge footprint limitations of previously approved contract docu is in compliance with the North Carolina Environmental Policy Act. The closure requirements stipulate that at least 1 feet of suitable soil cover be applied within 120 calendar days after completion of any phase of disposal operations or upon revocation of the authorization. The soil cover must be sloped to allow surface water runoff in a controlled manner. Please note that the regulations give the Solid Waste Section the authority to require fiuther actions if needed to correct any adverse condition.
