This correspondence is with reference to the request you submitted to modify State Permit No. 41-85. whici i11V.Va,
originally issued to Bald Head Island Limited on June 3,1996 for excavation and marina construction at Indigo
Marina adjacent to the Cape Fear River. This permit has been continually renewed and modified. The most recent
modification was issued on March 21, 2019 for bulkhead and dock repairs. The most recent renewal was issued
on December 21, 2022 and is due to expire on December 31, 2024.
The permittee is requesting one-time use of an upland spoil site for maintenance excavation of approximately 400
cubic yards of material within the existing marina basin. The upland spoil site is located at 2050 Trails End in
Southport, NC. A letter of permission from the property owner, Kenneth McClain, was included with the proposal.
Upon review of the information provided, the Division of Coastal Management has determined that the proposed
action continues to be consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State
Permit #i41-85, as described in your request dated September 1 and September 18, 2023. Please note this
refinement does not alleviate the need to obtain any other local, state or federal permits.

Letter of Refinement Request for upland spoil disposal
Dear Ms. MacPherson,:
Bald Head Island Limited, LLC has asked me, based on our yesterday e-conversation, to apply for a Letter
of Refinement for our needed dredging at the northwest comer of the Indigo Marina, where the old Bald
Head Island Ferry terminal was removed, somewhat recently, in the process of repairing the marina
bulkhead. As this is a 400 cu yd/small dredge project not in sequence with dredging of the full marina, the
dredge contractor, Coastal Dredging, proposes using a backhoe/bucket on a barge, and then transferring the
dewatered spoil to trucks for disposal at 2050 Trail End, Southport, NC. Below is the appx area requiring
this dredging.
Under separate submittal I will be applying for a repair exemption and/or LOR for replacement of the
along the bulkhead floating dock which was lost during the bulkhead failure, as well as the floating dock at
slips C9-C16 when that section was lost in the pre -post Hurricane Florence time frame of 2018-2019.
Bald Head Island Limited LLC is just now getting around to replacing them.
Project area is appx 190 if x 40', with 1' to 2' of material removal alon$ the wall tapering to the existing
basin appx -4 MLW at the 40' off the wall.
