Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no changes from the draft permit sent to you in July 2007. We have
thoroughly reviewed your request for exemption from our Water Treatment Plant Permitting Strategy. We are
unable to comply with this request for a five or more year period.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

This permit shall become effective November 1, 2007.
This permit and authorization to discharge shall expire at midnight on July 31,
2012.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
The Town of Beaufort is hereby authorized to:
1. Continue to operate a drinking -water treatment plant with a discharge of
water softener -backwash wastewater. This facility is located in Beaufort off
Pine Street at the Pine Street WTP in Carteret County.
2. Discharge from said treatment works at the location specified on the attached
map into an unnamed tributary to Town Creek, classified SC waters in the White
Oak River Basin.

1. Downstream sample at least 100 feet downstream of the discharge point.
2. The pH shall not be less than 6.8 standard units nor greater than 8.5 standard units.
3. Total Residual Chlorine limit and monitoring are effective only if chlorinated water is used for
softener regeneration and backwash. The limit becomes effective 18 months after the permit
effective date, monitoring shall begin immediately.
4. Acute 24-hour Pass/ Fail (Fathead Minnow OR Mysid Shrimp OR Silverside Minnow,
Permittee's choice) at 90%; March, June, September and December; refer to Special Condition
A (2).
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2. )ACUTE TOXICITY PASS/ FAIL PERMIT LIMIT (QUARTERLY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the
North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity
In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring
shall be performed as a Fathead Minnow (Pimephales promelas), or Mysid Shrimp (Mysidopsis Bahia),
or Silverside Minnow (Menidia Beryllina) (Permittee's choice) 24 hour static test. Once a test
organism has been selected, all subsequent tests must use the same test organism. The permittee
must notify the NPDES program of the selected test organism during the draft permit review period.
The effluent concentration at which there may be at no time significant acute mortality is 90%
(defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes
must be obtained during representative effluent discharge below all waste treatment. The tests will be
performed during the months of March, June, September and December.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGE6C (Fathead Minnow), or TGE3E (Mysid Shrimp) or TIE6B ( Silverside Minnow).

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response data.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is
employed for disinfection.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT)
test form indicating the facility name, permit number, pipe number, county, and the month/year of
the report with the notation of "No Flow" in the comment area of the form. The report shall be
submitted to the Environmental Sciences Section at the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately until such time that a single test is passed. Upon passing,
this monthly test requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may
be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

We are in receipt of the draft NPDES permit for the Pine Street Water
Treatment Plant. The proposed permit contains significant changes from our previous
permit, and we have the following questions and concerns.
■ The Town of Beaufort conducted a Comprehensive Water Study in March, 2005
that recommended replacement of the existing Pine Street WTP with a new
Water Treatment Facility.
■ The Town is currently in the environmental planning stages for the new North
Beaufort WTP which will replace the existing Pine Street WTP. Our
Consulting Engineering Firm, Rivers & Associates Inc., is under contract to
coordinate the test wells program, prepare the NPDES Engineering Alternatives
Analysis and conduct the Environmental Assessment associated with the new
plant.
■ Attached is the preliminary schedule developed by Rivers & Associates for the
North Beaufort WTP project that projects completion of the new WTP by June,
2012. At that time the Pine Street WTP will be retired.

■ Project status is as follows:
o Rivers has developed specifications for construction of the test wells and
developed a preliminary well field site layout map. The well drilling
construction work will be advertised shortly.
o Boundary survey work is currently being performed at the proposed plant
site location.
o The Town is currently working to obtain options for the new plant site and
potential wells sites.
o The Town, via Rivers, has submitted an environmental scoping document,
and received comments from Clearinghouse.
o An SRF Loan Application has been submitted to Public Water Supply for
consideration.
■ The Pine Street WTP is an accumulation of various processes housed within
several structures at the original public works complex. WTP facilities have been
located there in excess of thirty years. The existing building is even older. In
addition, there is no space on site for expansion of facilities.
■ Pine Street Well #1 was constructed in 1955. The well has been rehabilitated
previously, however, pumping capacity has been reduced from 420 gpm to 250
gpm due to decaying screens. Pine Street Well #2 was constructed in 1976.
■ The Town will continue to expend monies to operate and maintain this facility for
a few years more while the new WTP is being designed and constructed.
However, we nor our consultant believe that it is a prudent expenditure of scarce
resources to make capital improvements or to perform additional testing at. the
existing Pine Street WTP which is scheduled for abandonment.
■ We respectfully request that all of the new provisions contained in the draft
permit be eliminated, and that the current discharge permit be renewed as it exists,
given that the Pine Street WTP will be replaced with a new facility. We believe
that the requirements for monitoring of additional parameters, total residual
chlorine limit, and whole effluent toxicity testing is an undue financial hardship to
the Town that will not be of long-term benefit to the environment given that this
discharge will be eliminated in 2012.
■ If it is not possible to eliminate the new provisions contained in the draft permit,
we request that a time extension or some other mechanism be added to the permit
that will effectively preclude the Town from performing the required monitoring,
improvements and testing during the remaining life of the Pine Street WTP.

PART V - EVALUATION AND RECOMMENDATIONS
The facility has not provided any methods of wastewater treatment and discharges backwash water
from ion exchange softening units. The facility utilizes (gas) chlorine disinfection for potable water
and fluoridates the water as well. Backwash water is provided using chlorinated/fluoridated water.
The brine backwash removes calcium and magnesium chlorides in a soluble form. The plant
previously has not been rated, nor is rating recommended given the fact there is no treatment

The WTP permitting guidance for ion exchange (in it's entirety) should be imposed. The limit for
fluoride of 1800 µg/L and total residual chlorine limit of 13 µg/L should be imposed. The flow is
less than 0.50 MGD; therefore the monitoring frequency for limited parameters should be 2/month
and monthly for those not limited. Please refer to the attached (appendix B, page 5 of the WTP
permitting guidance for membrane technology) for the list of parameters that should be included. A
compliance schedule for the TRC limit can be given. A much shorter compliance window should be
given to the additional parameters, since it requires monitoring only.
The facility also has a brine tank that can overflow from the tank drain to the UT to Town Creek. A
discharge from this tank would be a nonpermitted discharge. The staff report writer in 2002
recommended the Division implement current policy for tank drains entering a permitted outfall.
During the site visit this tank was overflowing and discharging due to overfilling the brine tank.
Potable water is used for the brine tank which has a residual chlorine concentration of 1 mg/L.
Considering the previous request and this incident, WiRO reiterates the request for the Division to
implement current policy for tank drains entering a permitted outfall.
The Wilmington Regional Office recommends reissuance of the permit in accordance with the White
Oak River Basin Plan permitting strategy provided no significant adverse public comment is
received. The Wilmington Regional Office also requests that the recommendations provided herein
are considered in the reissuance of Permit No. NC0072699.

Your NPDES permit expires on July 31, 2007. Federal (40 CFR 122.41) and North Carolina (15A
NCAC 2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior
to expiration of the current permit. If you have already mailed your renewal application, you may
disregard this notice.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later
than February 1, 2007. Failure to request renewal by this date may result in a civil assessment of at least
$500.00. Larger penalties may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after July 31, 2007, the current permit must be renewed.
Discharge of wastewater without a valid permit would violate North Carolina General Statute 143-215.1;
unpermitted discharges of wastewater may be assessed civil penalties of up to $25,000 per day.
