Division personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General. Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Casar Elementary School discharges to a zero flow stream, UT Crooked Run Creek. Permit condition existed that they must meet existing tertiary limits or cease discharge by December 1997. Facility has not had a good compliance record. Casar Elementary was noted for violations of NH3, BOD5 and Fecal Coliform. CCS was fined by DWQ according to Mr. Larry McIntyre of the schools and Bob Sledge. CCS has considered relocation of outfall, DWQ provided them with spec limits for Casar Elementary in Dec. 1992. If the school relocates to a segment of Crooked Run Creek with a positive flow then limits of BOD5 = 30 mg/l, NH3 = 24 mg/l can be applied at the new discharge point. SOC application for all Cleveland County schools is currently in house. MRO staff met with Cleveland Co. Schools about a week ago negotiating for limits, working out schedules and monitoring requirements for the SOCs. MRO hopes to have the SOC request finalized very soon, per Rex Gleason telecon on July 27, 1998. Facility discharges into a zero flow stream and will renew at existing tertiary limits 5/2/6 and 10/4/6 at the current site. Will also include limits for the relocation site directly into Crooked Run Creek. SOC limits will probably be applied soon. Recommendation: Renewal of existing limits.
