The Division of Water Resources acknowledges your request to extend the review period for the
USACE 404 permit and corresponding DWR 401 water quality certification. AS such, DWR will place
the project on -hold pending receipt of the additional information requested that demonstrates
avoidance and minimization of impacts to surface waters and wetlands as required by 15 A NCAC
02H .0506 (b)(1) and the USACE email below. Once the information has been received DWR will
continue review of the 401 water quality certification application. Please feel free to call or email

Currently the application is considered incomplete due to missing impacts to aquatic resources
(Condition 32).
1. Two Non -wetland waters are shown on the delineation and appear to be impacted. There are
no impacts shown for these features.
Additional Question:
1. What is the reason for requesting an 18 and 29 when it appears that just 18 would work bases
on current plans. Please clarify.
2. Wetland impact 2A and 2B will need some more justification why these cannot be avoided.
Can the building be built with out impact to these areas? If it is just to have a square lot and
yard are then this would not be minimization or avoidance.
3. Wetland impact 3 needs justification. Why can the swell coming from the road not cross the
wetland and stop before getting into the wetland.
