application: Existing conditions consist of forested land with an existing 50' Right of Way and gravel road with a 58 LF
30" CMP at the end of the existing Suncrest Village Lane. The general land use in the vicinity of the project is residential
with the Neuse River to the west.

The purpose of the proposed project is to construct a residential development. As such, the current gravel road will need
to be constructed per the City of Raleigh's design standards, and minimal lot rill will be required.
3e. Describe the overall project in detail, including the type of equipment to be used:
The overall project consists of the construction of a road with utilities and 15 single family lots for a residential
subdivision. Specifically, there are stream, wetland & riparian buffer impacts associated an with upgraded culvert
necessary to replace an existing culvert, and additional wetland impacts associated with lot fill. Equipment typically
used for construction and earthwork such as backhoes, bulldozers, excavators, graders, pavers etc. will be utilized
for this project.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S &EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify
natural resources so that impacts could be avoided & minimized to the maximum extent practicable. Impact #1 is
proposed lot fill. This impact is necessary to make lots 10 & 11 buildable. This impact is proposing 0.06 acres of
wetland till. Impact #2 is a proposed road crossing. This impact is necessary to access the property and construct
a road per the City of Raleigh's design standards. Proposed impacts include 51 linear feet of permanent stream, 31
linear feet of temporary stream, 0.06 acres of permanent wetland, 0.002 acres of temporary wetland and associated
riparian buffer impacts. Headwalls have been utilized to minimize stream, wetland and riparian buffer impacts. At
temporary stream impact areas, the stream bed will be brought back to pre- construction elevation and the stream
bank will be stabilized post construction. Additionally, temporary wetland impacts will be brought back to pre - existing
wetland contours, stabilized and allowed to regenerate with existing wetland seed source.
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 29. With
respect to residential developments (NWP 29- Regional Conditions section 4.0) the applicant does not anticipate
any impacts to streams or wetlands associated with stormwater facilities, there are no impact associated with
single- family recreation facilities, the permanent wetland fill required by the road will utilize a NWP 14, the stream
classification for this project is C, NSW (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal
Wetlands or wetland adjacent to these waters) and riprap stabilization is not anticipated. The applicant is also aware
of the regional conditions associated with the Nationwide Permit 14. The applicant is not proposing to create any
upland for this project; the proposed stream crossings are strictly an upland to upland crossing. The stream
classification for this project is C, Nutrient Sensitive Waters (NSW) (i.e. not Outstanding Resource Waters or High
Quality Waters).
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
As per the project engineer, the proposed project will be constructed in accordance with an approved E &S plan
approved by the City of Raleigh. The plan will include silt fencing, sediment basins, cofferdam and pump around for
pipe installation.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill,
most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The
Suncrest Village -Phase 4 project is a residential development. Additionally, the project is located within the City of
Raleigh jurisdiction, therefore the adjacent properties that have potential for development will have the following
regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these
regulations require limited development within the riparian buffer area in addition to "diffuse flow "requirements at a
minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved, 2)
the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal
Separate Storm Sewer Systems (MS4s) in addition to post - construction stormwater management requirements.
We anticipate that the DWR will advise us if any additional information is needed.

Wake Forest Quad maps. Please note that the Bald Eagle was removed for the federal list of Threatened and Endangered

This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that
dispute a determination made by the DWR or Delegated Local Authority may request a determination by the

We are providing this letter in accordance with 33 CFR §332.8(r), to confirm that .12 Riparian Wetland Mitigation
Credits (Credits) from the Pancho Stream, Wetland & Nutrient Mitigation Bank (Bank) are currently available and
may be used, once transferred, for compensatory mitigation relative to the Suncrest Village — Phase 4 project, and
as proposed by Mitchell Mill Investments, LLC (Applicant).
The Applicant may ultimately purchase the Credits, if they are available, following Permit issuance. Should the
Applicant purchase the Credits at that time, we will complete and execute the Compensatory Mitigation
Responsibility Transfer Form (Transfer Form) within five (5) days of receipt of the full purchase price.
We will additionally provide copies of the completed and executed Transfer Form to the Applicant, the Bank's US
Army Corps ( USACE) Project Manager and, if needed, other regulatory agencies. In addition, we will provide USACE
with an updated copy of the Bank's Ledger, reflecting the transaction. Transaction information in the updated Bank
Ledger will include relevant Permit and Applicant information as well as the number and resource type of the debited
Credits.

We are providing this letter to confirm that .12 Riparian Wetland Mitigation Credits (Credits) from the Pancho
Mitigation Bank (Bank) are currently available and may be used, once transferred, for compensatory mitigation
relative to the Suncrest Village — Phase 4 project and as proposed by Mitchell Mill Investments, LLC (Applicant).
Our company hereby confirms that the Credits are currently available for transfer from the Bank's Ledger to the
Applicant at a cost of $14,200.
As of today we are placing these credits on reservation for a period of forty -five (45) days, or until the permit is
issued, whichever occurs first. If the Permit is not issued within forty-five (45) days of the date of this letter, we will
require the Applicant to place a non - refundable deposit in the amount of twenty percent (20 %) ($2.840) of the total
purchase price of mitigation needed. This will extend the reservation of credits for another thirty (30) days. The
Applicant will have ten (10) days from the date of Permit Issuance to tender full payment to the Bank. Following the
expiration of this ten (10) day period, if full payment has not been received by the Bank the Credits will be released
from reservation. We will then notify the US Army Corps (USACE) Project Manager triggering the requirement for a
permit modification by the Applicant.
Should the Applicant purchase the Credits within the relevant timeframe, we will complete and execute the
Compensatory Mitigation Responsibility Transfer Form (Transfer Form) within three (3) business days of the Bank's
receipt of the full purchase price.
We will further provide copies of the completed and executed Transfer Form to the Applicant, the Bank's USACE
