Discharge to Waters of the State without a Permit
Dear Mr. Hallock:
Between 9:20PM on September 21, 2023 and the morning of September 22, 2023, a pipe break caused a spill of
cardboard paper sludge from the Patterson Mill (NPS Holdings, LLC) to illegally discharge into the Yadkin River.
Mr. David Cunningham (Process Engineer, NPS Holding, LLC) contacted Ms. Rachel Rose (Asheville Regional
Office, Division of Water Resources, Environmental Specialist) to report the incident on the morning of September
22, 2023. Mr. Cunningham provided photographic and video evidence of the spill to Ms. Rose. Blue Ridge Tissue
Corporation (NPDES Permit No. NC0006254) caused an illegal discharge of cardboard paper pulp into Yadkin River
(03-07-01; Class C; Tr), and the following violation was identified:
VIOLATION
I. Discharge Without a Valid Permit — G.S. 143-215.1 (a) states that no person shall do any of the following
things or carry out any of the following activities unless that person has received a permit from the Commission
and has complied with all conditions set forth in the permit: G.S. 143-215.1(a)(1) — Make any outlets into waters
of the State.
Remedial actions, if not already implemented, should be taken to correct the above noncompliance. Please submit
a written response to this Notice of Violation. Your response is to be received by the regional office within 15
business days following receipt of this violation. Please include any additional documentation about this incident
in the response and include the steps that will be taken to prevent this type of illegal discharge from happening in
the future.
