The contractor removed the orange fence and silt fence and drove the track hoe in the creek. DOT was not notified that crews were working in area, and discovered it late afternoon. Below is an email with pictures from our lead inspector on the project. It's my understanding that there were no permitted impacts at the location of the unauthorized activity; however I'll have to confirm that tomorrow. I had them protect the area in case we had rains overnight. Our Resident Engineer has shut all operations down, except erosion control repair, maintenance and installations until further notice. Then Dragados removed the silt fence that ran along the bank of the jurisdictional stream. Dragados then operated a trackhoe in the jurisdictional stream and cleared. At no time did anyone inform the inspection crew of this work. If they had communicated the work plan for this area we could have been involved and prevented this incident. We had the Dragados reinstall silt fence along the stream bank to prevent anymore sediment loss. Email correspondence to and from this sender is subject to the N.C.
