Mr. Roscoe Green is the owner of an 11-acre tragt of land
located at the intersection of Green River Road and U.S. Highway '
25 in Henderson County, N.C. The site currently contains a gas f_
station/convenience store owned and operated by Mr. Green.
Mr. Green proposes to further develop his property by
constructing several other commercial enterprises. This proposed
development will generate domestic type wastewaters with the
anticipated flows -as follows: a�

Gas Station 3 water closets @ 250 GPD = 750
Restaurant 150 seats @ 40 GPD = 6,000
Library 3 employees @ 50 GPD = 150

WASTEWATER DISPOSAL AND DISPOSAL OPTIONS
The project site is located on a rather steep hillside
adjacent to U.S. Highway 25. The existing gas station is served
by a small septic tank/ground absorption system. The site has
been evaluated by the Henderson County Health Department for
additional drainfield and found to be unsuitable. There has been
major excavation work on the site and rock materials are evident
over much of the property.
The site is ideally suited for commercial development,
however, the lack of an acceptable means of wastewater treatment
and disposal has stopped any further use of the land.
Conventional septic systems capable of handling the total flow of
the proposed facilities cannot be approved due to lack of land
area and poor soil conditions. There are no other large tracts
of land nearby that could be purchased and used for drainfield
purposes. Land application has also been considered and could
possibly be pursued if agreements could be reached with adjacent
property owners to install spray irrigation equipment on their
property. This will be further explored during the discharge
permit process.
We are not aware of any existing public or private
wastewater collection/treatment systems within a reasonable
distance of this project site. Therefore, this alternative has
been dropped from further consideration.
Based upon the information available at this tune; • we ° ' '

PROPOSED TREATMENT WORKSPF
It is proposed to install a wastewater--ColIAN sy inn 1�idG�f�cFl�t ?t
consisting of 8-inch gravity sewer lines,, manholes, �e c. to serve
the commercial facilities. The waste ater'�'tr�atAM,"'Lalant will
be conventional package type secondarl plant. Discharge, of the
treated effluent will be to the Green•River at a locatiob
immediately across the road from the project site. Due to the
large upstream drainage area, we do not expect any adverse affect
upon the receiving stream from this discharge.
WASTE REDUCTION
The applicant has agreed to install water -saving fixtures in
all of the proposed facilities to minimize the wastewater flows
to the treatment plant.

PREVIOUS PROJECT COMPLIANCE
The applicant, R.J.G., Inc., is the sole owner/developer of
this project. To the best of my knowledge, this company nor Mr.
Roscoe Green has ever applied for an NPDES permit, owned,
operated or maintained a state approved wastewater collection/
treatment system prior to this project. The applicant appears to
have the financial resources to undertake this project, and I
have no reason to believe the system cannot be operated and
maintained in a proper manner.

General Statute Overview I
On October 1, 1989, an amendment to North Carolina General Statute 143-215.1, denoted as 143-215.1
(c) (6), became effective. The amendment allows input from local governments in the issuance of NPDES
Permits for nonmunicipal domestic wastewater treatment facilities. The new language requires that the
Commission (Environmental Management Commission) shall not act on an application for a new
nonmunicipal domestic wastewater discharge facility until it has received a written statement from each
city and county government having jurisdiction over any part of the lands on which the proposed facility
and its appurtenances are to be located. The written statement shall state whether the city or county has
in effect a zoning or subdivision ordinance and, if such an ordinance is in effect, whether the proposed
facility is consistent with the ordinance. -The Commision shall not approve a permit application for any
facili wh:ch a city o. county has deter:rined to be in consistent with f}s zoning or subdivision ordinance
unless it determines that the approval of such application has statewide significance and is in the best
interest of the State.
Instructions to the Anglican
Prior to submitting an application for a NPDES Permit for a proposed project, the applicant shall request
that both the nearby city and county government complete this form. The applicant must submit a copy
of the draft permit application and shall make a written request for this form to be completed to the clerk
of the city and county by certified mail, return receipt requested. If a (or both) local government(s) fai(s)
to mail the completed form, as evidenced by the postmark on the certified mail card(s), within 15 days
after receiving and signing for the certified mail, the applicant may submit the application for a discharge
permit. As evidence to the Commission that the local government(s) failed to respond within 15 days, the
applicant shall submit a copy of the certified mail card along with a notarized letter stating that the local
government(s) failed to respond within the 15 day period.
Instructions to the Local Government
The nearby city or county government which may have or has jurisdiction over any part of the lands on
which the proposed facility or its appurtenances are to be located is required to complete and return this
form to the applicant within 15 days of receipt. The form must be signed and notarized.
