The Division received your application for a wastewater discharge permit on June 2, 1998. Division
personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES
discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated December 6, 1983, and as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. Complete and submit the
enclosed Permit Name / Ownership Change Form if a change in ownership or control of this discharge occurs.
The Division may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

History
Dam was constructed to create water impoundment (lake) as part of Pavillon
development. Division of Water Resources and Wildlife Resources Commission
recommended that a continuous minimum flow equal to 2.0 cfs be released at dam to
maintain aquatic habitat and water quality. If inflow to lake is less than 2.0 cfs, the
minimum release may be reduced to equal inflow. In addition, if water is withdrawn
from lake for irrigation or other offstream uses, then the inflow prior to withdrawal or
2.0 cfs (whichever is less) must be released. USGS flow report indicates that at drainage
area of 4.05 mil, 7Q10S is approximately 1.0 cfs. Thus, because required minimum
flow of 2.0 cfs is greater than 1.0 cfs, a staff gage was installed downstream of dam
subject to 15A NCAC 2K.0504. Pavillon discharges downstream of dam.

- 980506 — Compliance Evaluation Inspection conducted by W. Frazier indicated
treatment system was well maintained and operating in compliance except for two fecal
coliform monthly average violations (March 1997 and January 1998). Inspection report
also stated Pavillon may add 20 more patient beds and staff. Actual flow is well below
permitted flow, thus permit modification will not be necessary for flow increase.
Request for Authorization to Construct would be required if construction to modify
WWTP was necessary to handle additional flow.
