Dear Mr. Jones:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

TO DISCHARGE WASTEWATER UNDER THE
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,
Indian Bend Properties, Inc.
is hereby authorized to discharge wastewater from a facility located at the
Willowbrook Park
17 McClure Mill Road
Franklin
Macon County
to receiving waters designated as Coweeta Creek in the Little Tennessee River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set
forth in Parts I, II, III and IV hereof.
This permit shall become effective April 1, 2003.
This permit and authorization to discharge shall expire at midnight on November 30, 2007.

1. Continue to operate an existing 0.0246 MGD extended aeration wastewater
treatment system with the following components:

The facility is located at Willowbrook Parkat 17 McClure Mill Road, Franklin in
Macon County.
2. Discharge from said treatment works at the location specified on the attached map
into Coweeta Creek, classified B-Trout waters in the Little Tennessee River Basin.

Dear Ms. Stephens:
Pursuant to the Notice from Mr. Weaver under date of April 4, 2002 concerning the above matter,
I am pleased to enclose herewith the Renewal Application as required for Willow Brook Park.
It is the purpose of this communication to request a renewal of the above permit and to advise that
there have been no changes at the facility since issuance of the last permit.
Pursuant to this request, I am enclosing herewith:
1. The original and two copies of this cover letter
2. The completed Application form signed by me, as Assistant Secretary, on behalf of the
Permitee, including an original and two copies.
3. Original and two copies of a narrative description of the Sludge Management Plan for the
facility.
It is my understanding that there is no renewal fee required to be paid upon the submission of this
application.

Enclosures
Sludge Management Plan
for
Willowbrook Park Wastewater Treatment Plant
Because ofthe limited use ofthe Willowbrook Park Wastewater Treatment Plant, very
little sludge (or other solids) are generated. The facility has made arrangements for disposition of
those solids generated as follows:
a) The Operator first disposes of the solids in the digester on site.
b) When the digester is full, or nearly so, the solids are disposed of by employing a
local septic tank truck operator to pump and haul them to the Town of Franklin
Wastewater Treatment Plant on Lake Emory Road. All fees involved in the pump
hauling and disposition are paid for by Indian Bend Properties, Inc. and/or the Willow
Brook Park Homeowners Associationa.
The policy above set forth is in effect as of the date hereof.

Subject: Notice of Violation
Compliance / Sampling Inspection
Willowbrook Park
Wastewater Treatment Plant
Permit Number: NCO070394
Status: Non -Compliant
Macon County
On May 15, 2001, Mr. Kevin Barnett of my staff inspected the wastewater treatment system Willowbrook
Park. Attached, please find an NPDES Compliance Inspection Report Form.
The facility has been found to be in violation of NPDES Permit Condition C. 2. Proper Operation and
Maintenance.
The following observations were made during the inspection:
• Influent pump station locked (debris on cover indicated that pump station not inspected regularly)
• Significant vegetative growth surrounds the treatment plant and several trees overhang the treatment
plant.
• Power supply outside of fence and unlocked.
• Treatment plant paint is peeling and rusting.
• Catwalks over plant need to be repaired, replaced. (Operator safety)
• Blower #1 operating, belt wom. (No spares on site) Air filter dirty.
• Blower #2 missing motor. (Not operational)
• Blowers on 30 min / off 90 min. Blower did not come on till 15 min into run period on timer.
• Sludge in plant is black. Mosquito larva on digestor surface.
• Plant is extended air, with 5 aerators. 3 aerators have caps blown off, 2 are stopped up.
• 1 tube in Cl contact chamber, containing 2 tablets.
• 1 tube on de -CI chamber, containing 3 tablets.
• Solids in both contact chambers.
• Denitrified sludge floating on top of clarifier.
No path to effluent pipe.
The following results were obtained by the Division of Water Quality from grab samples taken at the
point of discharge:

Willowbrook Park
The plant appears to be in a state of disrepair. The following actions must be taken in order to prevent
further enforcement action and possible civil penalty assessment:
• Influent pump station must be inspected daily and recorded in operators log.
• Vegetative growth around plant needs to be cleared. Trees overhanging plant need to be cut back /
removed.
• Power supply must be secured by either fencing it in, or locking the switch.
• Regular maintenance of the treatment plant should include painting to maintain structural integrity.
• Catwalks over plant need to be repaired, replaced for operator safety.
• Both blowers must be operational at all times. Spare parts inventory should include belts and filters.
• Blower timer should be repaired or replaced.
• Wastewater sludges should be pumped out of the plant on a regular basis. Insect larvae should not
be present on any wastewater treatment units.
• Aerators should be repaired, serviced or replaced.
• Solids must be pumped out of the contact chambers.
• No sludges should be floating in the clarifier.
• A path to effluent pipe must be maintained.
Additionally, the operator's log must contain more detail. Attached, please find a copy of the 15A.
NCAC 02B .0500 rules detailing the minimum requirements for the operator's log.
All repairs / modifications must be made immediately, or within 45 days if equipment needs to be
ordered. A plan of action covering these repairs should be prepared and mailed to my attention at the
letterhead address.
Nothing in this letter should be taken as removing from you the responsibility or liability for failure to
comply with all applicable state laws and regulations.
