(S&ME) is submitting this Preconstruction Notification Form for the above-referenced project as application for a U.S. Army Corps of Engineers (USACE) Nationwide Permit No. 14 (NWP 14) for linear transportation projects and concurrent North Carolina Department of Natural Resources (NCDENR) Division of Water Resources (DWR) Water Quality Certification No. 3886 (WQC 3886). A USACE Agent Authorization form signed by the WCBOE is included in Appendix II. BACKGROUND INFORMATION The Wake County Public School System (WCPSS) is constructing an elementary school (E-37) west of White Oak Church Road in Cary, North Carolina. As part of the project, the WCPSS is required by the Town of Cary and the North Carolina Department of Transportation (NCDOT) to make road improvements to the intersection of Green Level West (SR 1605) and Green Level Church Road (SR 1625) to handle the increased traffic. Land use surrounding the intersection is primarily forested with some commercial, residential and recreational areas. The NCDENR-DWR issued a Surface Water determination Letter (NBRRO#14-023) on February 11, 2014 which is included in Appendix IV. S&ME visited the project site on August 1, 2015 to record routine data forms and to take site photographs. The data forms are included in Appendix III and the site photographs are included in Appendix VI. The USACE has not visited the project site to confirm the delineation, however the USACE Jurisdictional Determination Request Form and USACE Preliminary Jurisdictional Determination Form are included in Appendices VII and VIII respectively. Plans for the road improvements will result in impacts to jurisdictional wetlands at two locations, Area 6 which is northeast of the intersection and Area 7 which is southeast of the intersection. The total wetland impact at Area 6 and Area 7 will be limited to 0.22 acres of construction fill for road widening as shown in Appendix I. Compensatory mitigation for the proposed wetland impacts will be required at a 2:1 ratio as specified by the USACE and a NCDENR Division of Mitigation Services Compensatory Mitigation Acceptance Letter issued on August 4, 2015 is included in Appendix V. The site plan has been designed to minimize impacts to the jurisdictional Waters of the U.S. by minimizing the proposed widening and associated filling and grading to the full extent practicable while still meeting the requirements of the Town of Cary and the NCDOT. Appropriate sediment and erosion control practices equaling those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" will be used. Endangered Species and Designated Critical Habitat (Corps Requirement) Literature Review Protected Species S&ME's review of potential protected species habitat included a literature review of existing records obtained from federal and state sources. The U.S. Fish and Wildlife Service's current list of federally protected species was consulted for a listing of protected species within Wake County, North Carolina. This review identified one protected plant species and two animal species. Listed fauna and flora and their federal status are identified in Table 1. Explanations of rankings are included at the end of the table. One animal species was recorded within the project area (EO ID 32043). This elemental occurrence was identified by Suzanne Mason of the NCNHP on March 20, 2015 as the regal darner (Coryphaeschna ingens), a dragonfly species listed within North Carolina as Significantly Rare, a designation with no legal protection status. This occurrence is county wide with very low accuracy. This EO is identified in Table 2. Twenty-two historic resources were identified in the vicinity of the project area. Of these, only the Green Level Historic District, which is on the National Register, is partially located within the project boundary. Four historic resources are located adjacent to the project area; the Green Level Community Store and Vic Council House which are no longer present, the A.C. and Helon Council House, and the Vic Council Rental House. Of the twenty-two sites identified, one is a National Register Historic District, one is on the study list, seventeen have been surveyed only, and three have been surveyed but are gone. No impacts to historic sites are anticipated as a result of this project. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT Prior to final production of a Plat, the Wilmington District recommends that the Land Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for review. Due to storage limitations of our administrative records, the Corps requires that all hard- copy submittals include at least one ori inal Plat to scale) that is no lar�er than 11 "x 17" (the use of match lines for larger tracts acceptable). Additional copies of a plat, including those larger than 11 "x 17", may also be submitted for Corps signature as needed. The Corps also accepts electronic submittals of plats, such as those transmitted as a Portable Document Format (PDF) file. Upon verification, the Corps can electronically sign these plats and return them via e-mail to the requestor.
