16. Grant Project Ordinance Amending Ordinance 12604 for Workforce Investment Act
Federal Employment Funds
To adopt the amended grant project ordinance to formally incorporate $251,343 in

To authorize the City Manager to execute an interlocal agreement with Chatham
County for the cooperative cost sharing of a long-term solid waste planning study
in which the City's share of the amount is $3,500, and
To authorize the City Manager to modify the contract before execution provided
the modifications do not increase the dollar amount of the contract and are
consistent with the general intent of the version of the contract approved by City
Council.

SUBJECT: Information Item for NPDES Stormwater Permit Renewal and
Delegation of Authority to Implement the NPDES Stormwater Permit
DATE: April 24, 2003
Executive Summary
The City of Durham is required to renew its National Pollution Discharge Elimination System
(NPDES) Stormwater Permit (Permit#NCS000249). The Permit renewal application is to be
submitted to the North Carolina Department of Environment and Natural Resources, (NCDENR)
Division of Water Quality by June 2, 2003. The Permit renewal will require the implementation
of additional ordinances to control stormwater runoff from new development and redevelopment
projects by March 10, 2005. The Public Works Department is requesting that the City Manager
be authorized to act on behalf of the City concerning all applications or requests necessary for
the implementation of the City of Durham's NPDES Stormwater Permit. It is anticipated that the
City Manager will delegate to the Director of Public Works the authority to act on behalf of the
City concerning all applications and requests necessary to implement the NPDES Stormwater
Permit.
Background
The City of Durham is currently operating under its original Stormwater Permit. A Stormwater
Permit Renewal was applied for on December 23, 1998. The renewal application was
acknowledged on October 7, 1999 by the NCDENR. Division of Water Quality, but no action
was taken by the Division of Water Quality. The City of Durham was authorized to continue
operating under its existing permit and allowed to implement program elements outlined in the

renewal application that would make the stormwater program more efficient and effective. The
current Stormwater Permit Renewal Application will continue to refine existing programs to be
more effective.
Issues/Analysis
The Stormwater Permit Renewal Application deadline is June 2, 2003. The only significant
addition to the existing Stormwater Permit will be to implement additional ordinances to control
stormwater runoff from new development and redevelopment projects. The new ordinance must
be implemented by March 10, 2005. Delegating the authority to act on all applications and
requests necessary to implement the NPDES Stormwater Permit to the City Manager or her
designee will streamline the process leading to greater effectiveness of the Stormwater Program.
Alternatives
The alternative is to continue to route all matters related to implementation of the NPDES
Stormwater Permit to the City Council for approval.

There are no costs associated with this item.
