Stevens, Director Division of Water Quality February 9, 2001 Subject: NPDES Permit Modification Permit NCO083275 Dan River Inc. — Harris Facility Rutherford County On November 7, 2000, the Division received your request to modify permit NC0083275. Due to your addition of a cold pad dye process, a summer color monitoring requirement and a Color Monitoring and Reopener Special Condition have been added, to the permit. This is in keeping with the basin plan for the Broad River Basin and will allow for the collection of color information during this permitting cycle. Please find enclosed the revised permit pages. The revised pages should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143- 215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. t If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Instream samples shall be collected as grabs There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit No. NCO083275 A. (3.) COLOR MONITORING AND REOPENER — The permittee will monitor color on a monthly basis during summer season (April — October). Monitoring will include effluent and instream samples for ADMI color at natural pH. Effluent samples will consist of 24-hour composites, while instream samples will be collected as grabs. Samples will be analyzed by a state certified laboratory. If data show that water quality standards for color are being violated by the discharge permitted by the terms of this permit, then the Director may reopen this permit for the purpose of imposing a requirement to perform a color reduction study pursuant to 15A NCAC 21-1.0114.
