Lee County
In response to the Petition for a Contested Case Hearing, the Division is issuing the attached
effluent limits pages as a permit modification as agreed in settlement of this case. I apologize for the
time lapse between the settlement agreement and the issuance of this permit modification. This should
be the last step in resolving this matter. Please be advised that an Authorization to Construct permit is
forthcoming shortly for the new wastewater treatment system.
Please note the attached effluent sheets should be placed in your permit and the old ones
discarded. All other terms and conditions contained in the original permit remain unchanged and in full
effect. These modifications are issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency dated December 6, 1983.

I Sample locations: E - Effluent, I - Influent, U - Upstream at NCSR 1400, D - Downstream, 50 feet above City of Sanford outfall. All stream samples shall be grab samples.
Instream sampling shall be conducted 3/week during June, July, August and September and weekly during the remaining months of the year.
2 The daily average dissolved oxygen effluent concentration shall not be less than 6.6 mg/L.
3 The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. '
4 Chronic Toxicity (Ceriodaphnia) P/F at 9.0%; January, April, July and October; See Part III, Condition E.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
