Please note that this decision is based on this current project/scenario and should not be considered applicable to any other projects with design changes after the 401 has been issued. Hi Sue You issued an Individual 401 WQC for the Carolina Shores Shopping Center in Brunswick County back in January, which authorized impacts to 0.164 acre of open water jurisdictional ditch and 0.684 acre of wetlands. The site plan was modified slightly back in May and I neglected to send it to you (attached). My apologies for this oversight. The only change is the placement of the road near the wetland impact. The reason for the change is that NCDOT required that the location of this access road be moved to the northeastern site boundary. Access on US 17 is highly restricted since that is a Limited Access Highway. NCDOT required that the driveway be pushed further to the north to maximize the required U-Turn spacing for the revised plan. This is the only configuration that NCDOT would approve. The engineer made several adjustments and ditch and wetland impacts are the same as previously proposed. As the Permittee, we just want to make sure we close the loop on the 60 day appeal period as soon as possible. So to clarify, no further Public Notice is required to effectuate the 60 day period. It will simply expire 60 days from the 1/9/23 date... correct?
