FACILITY OVERVIEW:
This facility is 100% domestic waste and treats flow from subdivisions with a population of 1,500 people. The
facility has a permitted flow of 0.117 MGD and as -built flow rate of 0.117 MGD. The plant was originally a
private system but was taken over by the Town of Fuquay-Varina in 2007. The treatment system includes the
following wastewater treatment components:
• Influent pump station • Hopper bottom clarifiers
• Two train carbon steel package treatment plant • Cloth Media Disc Filter
• Equalization basin • Tertiary filters (backup)
• Sludge holding basin • Ultraviolet disinfection system
• Aeration basin • Dechlorination system (backup)
The Town also holds Collection System permit WQCS00193 which covers this treatment system and the Town's
main WWTP.
APPLICATION
The application (March 2023) does not indicate any changes in the facility or treatment since the last renewal of
the permit in 2018. The treatment system is owned and operated by the Town of Fuquay-Varina. The annual
average daily flow is indicated as 0.052 MGD at the time of the renewal application. The facility is currently
operating within its permitted capacity. Maximum daily flow is shown as around 0.08 MGD which is still well
below the permitted and as -built flow of 0.117 MGD.
The application notes the system as serving a population of around 1,500 people and as having primary and
secondary treatment that achieves 90% BOD and TSS removal. The application indicates the use of a
contractor, McGill Environmental Systems, for thickening sludge composting. The application process flow
describes a system that includes a bar screen, aeration basin, clarifier, pump station to disc filter and UV
disinfection.
INSPECTION
The most recent inspection occurred on February 28, 2019. The inspection report noted the following: need to
routinely test thermometers against certified equipment; need for correction of a DMR value entered
inaccurately; need for repair of a visual alarm at the influent pump station; need to address sludge depth in the
clarifiers and repair of UV lights. The town responded promptly to the issues outlined.
The Town's Collection System (WQCS00193) was last inspected on May 31, 2018 and included review of sewer
lines associated with multiple discharge permits, including Brighton Forest (NC0066150). The inspection did
not find any major issues or violations at the time. There have been a number of NOVs, NODS and enforcement
actions over the last five years related to SSOs. Because the collection system permit is associated with multiple
facilities it is difficult to determine if any of these are related to the Brighton Forest facility.

REVIEW OF PERMIT LIMITS:
Flow - Over the permit cycle the facility has had average flow of 0.05 MGD There were no monthly average
exceedances over the permit term. The system is operating well below its flow limit of 0.117 MGD.
BOD / TSS- There were no violations or major issues with BOD and TSS limits. The facility has shown average
monthly BOD and TSS removals of 99%.
Fecal - Data results for Fecal Coliform showed one (1) weekly average limit exceedances for Fecal. No major
ongoing issues indicated
Dissolved Oxygen - The DO limit in the permit was changed in the last permit renewal to 5 mg/L. There was
little explanation other than a statement that the limit was updated. As a zero -flow stream 15A NCAC 213.0206
indicates the DO limit should be 6 mg/L. With this limit the Town would have had 87 DM limit violations over
the permit cycle. The draft permit changes the DO limit back to its required level of 6 mg/L. The town will have
to evaluate needed changes to assure compliance with the required permit limit.
Ammonia (NH3-N) - The facility has shown no violations for ammonia limits with the exception of one (1) MA
winter limit violation. The current weekly average limits for NH3-N found in the permit are inaccurate. In 2007
the town took over ownership and operation of the Brighton Forest WWTP. Previously the WWTP was a
private treatment system and had limits that were monthly average and daily max limits. Daily maximum limits
were set at five (5) times the monthly average. When the system changed to a public treatment system the
limits were changed to monthly average and weekly average limits consistent with requirements for other
publicly owned treatment works. The daily maximum limits were just reassigned as weekly average limits at
that time. However, weekly average limits are to be set at three (3) times the monthly average, not five (5)
times. The draft permit has corrected these weekly average limits. The new weekly average limits have been
set as: summer - 6 mg/L and winter -12 mg/L. Based on reviews of the previous permit cycle data these
weekly average limits should be readily obtained by the current treatment system.
Nutrients
Total Nitrogen load numbers over the permit cycle included a maximum annual load of 7,803 lbs and average
annual load of 6,874 lbs. The allocation for the facility is 2,366 lbs per year so the facility is regularly over its
annual allocation for TN. Total Phosphorous is currently within its quarterly average limit of 2 mg/L. The
current permit included a footnote and reference to the annual load allocation as a limit, however by rule
facilities less than 0.5 MGD do not have nitrogen load limits at this time. This footnote has been removed and
the special condition for Annual Limits for Total Nitrogen has also been removed as this does not apply.
COMPLIANCE:
The Town has had no enforcement actions for this facility over the permit cycle. There have been three (3)
NOVs - one for a frequency violation, one for a late DMR and one for two permit limit violations.
RECEIVING STREAM
The current permit and information in BIMS note the stream segment as 27-43-15-(1) which is a segment of
Middle Creek from source to the backwaters of Sunset Lake. This discharge is actually below that area and
drains to segment 27-43-15-(4). This correction has been made in the permit and in BIMS. The classification of
the stream is the same - C; NSW.

FILE HISTORY REVIEW SUMMARY
• Permit was originally issued in August of 1986 but it doesn't appear that the facility was active until 2008.
• There are no WLA documents available in the files. The earliest file is from 2004. No information on
receiving steam flow in the available permit renewal documents, but BIMS indicates zero flow for 7Q10 and
30Q2.
• November 2004 - Engineering Alternatives Analysis (EAA) submitted for this facility and three others in the
general location (Amherst subdivision, Crooked Creek subdivision and NC Center for Mature Adults). The
EAA evaluated various alternatives for all four facilities and recommended no changes to Amherst and
Crooked Creek; constructing the permitted system for Brighton Forest; and sending the NCCMA discharge to
Crooked Creek. The document included the 2003 Permit Renewal for the Brighton Forest WWTP owned by
FMRK, LLC and contained the following permit requirements (limits given as MA/DM):

The permit also included monitoring/reporting for temperature, total nitrogen and nitrogen load (monthly
and annually). Instream monitoring was required for DO. The 2003 permit cover letter noted that NC
Wildlife Resources had requested that if the facility was constructed, UV disinfection should be included to
avoid potential impact from chlorination/dechlorination. The permit required authorization before
construction and operation of the treatment system.
• August 11, 2005 Authorization to Construct (ATC) for construction of 0.117 MGD WWTP with discharge to
Middle Creek.
• BIMS Info - June 4, 2007 Inspection notes that the facility has been constructed, but is not operational. No
houses have been complete, but they hope to have homes sold and occupied in the next few months.
• July 17, 2007 - Engineers Certification for the 2005 ATC. This document notes that FMRK, LLC has deeded
the plant and operations to the Town of Fuquay-Varina.
• August 29, 2007 - Name / Ownership change to the town. Also transfers WQ0030454 and WQ0030287.
• November 2008 - first DMR data entered in BIMS.
• October 14, 2008 - Permit Renewal -The permit cover letter notes Middle Creek as impaired and indicates
that if the discharge is shown to impact the stream then permit revisions may be required. Now that the
permit is a municipal system, limits are changed from MA and DM to MA and WA. The DM limits for NH3-N
where inaccurately moved over to WA limits but should have been set at three (3) time the WA limits. This is
discussed earlier in the Fact Sheet. BOD and TSS requirements for 85% monthly average removal are added
to be consistent with municipal system requirements. The renewal adds seasonal limits for BOD and NH3-N
as requested by the permittee. The treatment system components list was updated to be consistent with
the 2007 Engineer's Certification for system construction. TN allocation section added to the permit. The
permit also includes some references to the TN allocations as a TN limit (this is not accurate for < 0.5 MGD
facilities).
• July 5, 2013 - Permit Renewal - The renewal updated TN and TP language and reduced nutrient monitoring
frequency to 2/month. Mercury monitoring was added for one sample over the permit term (Mercury
Section). Based on the Town's membership in the Lower Neuse Basin Association (monitoring) the permit
waives the required instream monitoring for DO and temperature, as long as membership is maintained.
Raleigh Regional Office comments note that the subdivision is still not built out. Inspection report notes
that only one treatment train is in use and notes that the tertiary filter noted in the permit is really effluent
polishing but is okay with the description in the permit. The RO notes low DO issues due to the area not
having enough flow to get stagnant water to move.
• July 25, 2018 - Permit Renewal - Permit changed DO limit from 5 to 6 mg/L. Fact sheet says DO limit
"update" with no other explanation for the change. See discussion above in Limits section. eDMR language
added to the permit and regulatory citations added. Mercury monitoring section was removed (no
discussion but one sample result was very low).
• April 26, 2019 - ATC to relocate a cloth media disc filter from another Town WWTP and add two new
pumps and other related components. The old tertiary filters will remain for backup purposes.

PROPOSED PERMIT CHANGES:
• Updated eDMR requirements to be consistent with final EPA rule.
• Added or updated regulatory citations throughout permit as needed including updates of rule references
for Neuse requirements.
• NH3-N weekly average limits have been corrected to be consistent with guidance of three (3) times the
monthly average. The permit was originally a private WWTP that had monthly average and daily max
limits. The daily max limits (5 times the monthly average) were carried over as the weekly average limit
when the system became a publicly owned treatment works.
• The DO limit in the permit was changed in the 2018 permit to 5 mg/L. Little explanation was given for the
change. Based on rule requirements for zero flow streams the limit should be 6 mg/L and this permit
renewal reflects the change back to 6 mg/L.
• Previous language in the permit implied that the TN allocation in the permit was a permit limit. This
treatment system is < 0.5 MGD and by rule does not currently have a TN limit. This language and footnote
have been removed.
• Some language in footnotes has been modified to be consistent with current language.
• Stream Segment corrected to 27-43-15-(4).
• Added Special Condition for Nutrient Re -opener in section A.(4.).
• Permit map information updated.

I'm sorry I didn't get back with you on this earlier, it slipped my mind. If you are looking at grants/loans then you need
to talk with staff in the Division of Water Infrastructure. I'd suggest going to their website at this link:

flow to gravity where the flow would be then treated at our Terrible Creek WWTP. In the application we have

The Town of Fuquay-Varina appreciates the opportunity to respond to the draft permit
dated August 8, 2023. The Brighton Forest Wastewater Treatment Plant is classified as a Grade
II Biological Water Pollution Control System (WPCS) in the draft permit but should be classified
as a Grade III Biological WPCS due to the phosphorus limits outlined in the permit.
The Town does not have any additional comments at this time but please do not hesitate

Just noticed that the cover letter on this one incorrectly says they are Grade II. It is correct in the permit itself as Grade
III. They are a small treatment system, but they do have a TP limit so that pushes them to Grade III.

• BIMS shows the facility grade is WW-3 not WW-2. The cover letter, permit and factsheet will need to be
corrected.
• On the permit cover letter, I noticed the "B" was missing from the "02B" of the rule citation for nutrients.
• I think the footnotes on the permit glitched a bit. The map shows "Page 10 of 9" in the footer.

Apologies for the late reply. We're down to 1 senior NPDES inspector and 1 newbie Q. Stephanie Goss did the last
inspection at Princeton. A cursory review of the inspection report didn't reveal any outstanding issues. The inspection
was conducted as a sampling inspection.
For Brighton and Lassiter, the last inspections were conducted in 2019. These will likely be targeted for inspections the
next federal fiscal year. Both of these inspections were conducted by staff who are no longer with our unit.

I just wanted to touch base on renewals that are coming up for me and get contacts in the region for any issues with
these.
• Town of Princeton WWTP — NCO026662 - I am starting the review of this renewal and wanted to see if you guys
have anything you wanted to pass along on the review. It does look like they have had a number of NOVs and
enforcements over the permit cycle. Also, they got Speculative Limits earlier this year for future expansions to
0.6 and 0.95 MGD. We haven't seen any actual expansion requests at this point. I have asked them for
information on their timeframe with this to see if we move forward or hold on this one.
• Town of Fuquay- Varina / Brighton Forest WWTP — NCO066150
• Aqua North Carolina / Lassiter Farm Subdivision WTP — NCO088714
Let me know who in the RRO I should be in touch with on these permits.

My goal is to submit the application by the end of business day Friday February 24th.
Question...
Will the Town of Fuquay-Varina be issued a NOV or assessed a civil penalty as a result of not submitting the renewal
application within the required timeframe?

The NPDES discharge permit for the WWTP mentioned in the Subject line above will expire on April 30, 2023. At this
point our records do not show receipt of a permit renewal application for this facility. Renewal applications are due 180
days before expiration of the current permit. This deadline is established in Federal and State requirements [33 USC
1251, 40 CFR 122.21 (b), and 15 NCAC 21-1.0105 (e)] and in the conditions of your exiting permit [Part II Section B.
Paragraphs 9. and 10.] Discharge of wastewater without a valid permit is a violation of Federal and State requirements.
If no renewal application is received, the Division is required to make the permit Inactive.
