Thank you for allowing the Lake Norman Woods HOA the opportunity to respond to this Notice of Violation
dated September 13, 2023. This response pertains to the (1) fecal coliform daily maximum exceedance that
occurred during the July 2023 monitoring period.
On 7/25, the fecal coliform sample bottle was inadvertently contaminated at the time of collection, resulting in a
fecal coliform exceedance reported for the sample collected on this date. The lab did not recommend re -sampling,
since all other fecal coliform results for July 2023 were <1 mg/L, and there was no resulting violation of the
geometric mean. Considering that there was contamination of the sample bottle, it is reasonable to conclude that
this sample was not representative of the actual amounts of fecal coliform present in the effluent at that time. The
plant was otherwise compliant during the month of July 2023, and has remained compliant throughout August and
September 2023 as well. No further fecal coliform exceedances have occurred since this incident.
We believe that the Lake Norman Woods HOA and WWTP operational staff have responded to these issues to the
best of our ability and in good faith. It is always our goal to remain in compliance with regulations set forth by the
North Carolina Division of Water Resources. In the event of considering financial enforcement, we request that
the Division take this factor into account when proceeding with enforcement.
