Describe the attachments or comments: A Modification of this project is requested as there are three failing structures that need to be replaced within the project area, that weren't included in the original permit or reverification. These replacements will result in jurisdictional impacts, which need to be accounted for in the existing permit. The project has started, but no work to the three newly proposed sites will occur until after the modification is approved. The previously issued 404 and 401 Permits (both the original and reverification) are attached. There have been no changes to design or impacts of the previously permitted sites - the only change is the request to add the three newly proposed sites. Section 7 A new IPaC review was conducted on September 14th, 2023. All of the listed species shown on this newer IPaC review were included with our previous Section 7 analysis, and there are still no critical habitats listed for the project area. The only change compared to the previous Sec 7 review is the addition of two proposed species - Tricolored Bat and Green Floater. These are discussed within the Sec 7 portion of the summary letter on page 2 of the attachment. NCWRC We will still follow the trout moratorium for the three added sites, and expect that the replacement of the two existing pipes with bottomless structures will have positive impacts to aquatic species within the project area. NCDOT has already contacted NCWRC, and while they still will have an opportunity to consult formally, their initial response was favorable and with no concerns. Archaeology and Historic Properties There have been no changes to the original Archaeology review, as our staff determined the previous review and April 2017 No National Register of Historic Places Eligible Sites Present form was still valid with the three proposed additions. However, Historic Architecture resulted in the need to do another Assessment of Effects, which was conducted in late August, 2023. This review resulted in No Adverse Effects with an environmental commitment of installing a rock form liner on the proposed replacement structure for pipe 127 and pipe 157.
