Dear Mr. Sir or Madam:
The NC Division of Land Resources (DLR) has informed our office that they have approved the Erosion and
Sedimentation Control Plan (E&SCP) for the abovementioned land disturbing activity. Please be aware that, upon
approval of your E&SCP by DLR, you, as the project's financially responsible party, were also issued a general
stormwater permit (NCG010000) to discharge stormwater associated with construction activities. Our office, of the NC
Division of Water Quality (DWQ) enforces these permits, and therefore the site is subject to inspections by DWQ in order
to assess compliance with the NCGO10000 general permit.
Please read the NCG010000 general permit in detail to become thoroughly familiar with all permit requirements. Also
bear in mind that the NCG010000 general permit remains in full force at the site until DLR deems the, site to, be complete
and thoroughly stabilized and closes their permit for the project. Some of the major permit requirements are outlined
below:
1. You, or your authorized designated representative, must maintain a copy of the approved E&SCP on site at all times.
2. You, or your authorized designated representative, must maintain a rain gauge on site at all times and keep a record
of all rainfall amounts and dates.
3. You, or your authorized designated representative, must inspect all erosion and sedimentation control (E&SC)
measures specified on the approved E&SCP and all stormwater discharge outfalls (SDO) at least once every seven
calendar days and within 24 hours of any storm event measuring greater than % inch of rain per 24-hour period.
Inspection frequency requirements vary at some sites based on the, classification of the receiving stream; again
please review the entire general permit in detail to ensure you thoroughly understand all requirements and what
constitutes an SDO.
4. You, or your authorized designated representative, must provide the operation and maintenance. necessary to
maintain all E&SC measures and stormwater controls at optimum efficiency at all times and take immediate
corrective action when measures or controls are not functioning properly.
5. You, or your authorized designated representative, must notify our office within 24 hours if you observe significant
amounts of sediment being discharged from the site into any receiving water body, and provide a written notice of all
such events to our office within 5 days working days. Please also bear in mind that a dry creek bed, stormwater ditch,
or anv other manmade or natural feature that conveys water at any time of year, may also be considered a receiving
water body. Please refer to the permit for the definitions of SDOs and receiving waters.
It is your ultimate responsibility, as the project's financially responsible party, to ensure complete compliance at the
site with all permit requirements at all times. You should ensure that all individuals performing construction activities at

the site are also thoroughly familiar with the permit and E&SCP requirements. A copy of the general permit as well as the
monitoring form you must use can be obtained from the following web site:
http_//h2o.enr.state.nc.us/su/Forms Documents.htm. A copy of the permit technical bulletin as well as a sample copy of
the monitoring form you must use is'attached.
It is imperative that you understand that Director of the Division of Water Quality may assess civil penalties not to
exceed $25,000 per day, per violation, upon you, the project's financially responsible party, for any and all violations of
the NCG010000 general stormwater permit at the project site. If you have any questions regarding this letter or the
