4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: *
The proposed project, Lakewood Avenue Stream Stabilization and Enhancement, is located in two sections along the southern side of Lakewood Avenue between the intersection of
University Drive and South Duke Street and South Roxboro Street in Durham, Durham County, NC. The area surrounding the project is largely residential housing, with scattered
commercial development.

The purpose of the proposed project is to repair, stabilize, and enhance two sections of stream S1 to improve the water quality functions of the stream and floodplain. This will be
completed through the enhancement of the natural ecosystem and riparian community, control and reduction of streambank erosion, and improvement of aquatic and terrestrial habitat.
Additionally, the existing sidewalk adjacent to stream S1 will be replaced within its existing footprint to improve pedestrian safety and reduce future erosion in the stream channel as part of
the repair and stabilization of the eroding banks of stream S1.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:
The project is proposing to stabilize and enhance two lengths of stream S1 located south of Lakewood Avenue. The proposed stream repair will include the grading of damaged and
unstable stream banks to match natural channel contours, the placement of rip rap, rock toe protection, and brush toe protection along the stream banks to provide stabilization, and the
installation of cross vanes, step pool structures, rock and roll riffles, and log J-hook riffles within the stream to establish grade control, reduce streambank erosion, facilitate sediment
transport, and enhance aquatic species habitat. The constructed riffles will also create profile variability that is currently lacking in the system. The Piedmont Regional Hydraulic Geometry
Curve data was used as a reference point for the proposed stream channel geometry and grade control structures. As part of the stream repair, stream banks that have been graded and
disturbed will be replanted with live stakes, bare roots, and herbaceous plugs to promote vegetation establishment and restore the overall function of the riparian buffers. Additionally,
portions of the existing sidewalk adjacent to stream S1 will be replaced within its existing footprint to improve pedestrian safety and reduce future erosion in the stream channel as part of
the repair and stabilization of the eroding banks of stream S1. Construction equipment typical of stream repair and sidewalk replacement projects will be utilized including bulldozers,
excavators, graders, cranes, dump trucks, concrete trucks, and pavers.

Comments:
Kimley-Horn staff delineated the project corridor on June 1, 2020 and June 20, 2023 and identified 4
streams within 50 feet of the project corridor (S1, S2, S3, and S4) (Figure 3). A Preliminary
Jurisdictional Determination Request for the Lakewood Avenue Stream Stabilization and
Enhancement project has been attached as part of this permit application. Additionally, small portions
of the project corridor overlap with an existing Preliminary Jurisdictional Determination (SAW-2021-
00554) that was issued by April Norton of the USACE on May 13, 2021. A Buffer Determination
(NBRRO# 21-67) was issued by Chang Zhang of the NCDWR on April 29, 2021 that confirmed
streams S1-S4 and determined the applicability of protected riparian buffers for those features. The
above referenced determinations are included as part of this permit application package.

Unavoidable permanent impacts to an unnamed tributary (stream S1) will result from the enhancement of the channel and banks, resulting in no loss of
waters. Stream repair and enhancement activities will include the grading of damaged and unstable stream banks to match natural channel contours, the
placement of rip rap, rock toe protection, and brush toe protection along the stream banks to provide stabilization. These enhancement activities will also
include the installation of cross vanes, step pool structures, rock and roll riffles, and log J-hook riffles within the stream to establish grade control, reduce

6i. Comments:
Permanent buffer zone 1 and zone 2 impacts along stream S1 will result from stream enhancement activities including the grading back of stream banks
and the installation of structures to prevent future erosion within the limits of disturbance (LOD). Outside of the LOD, permanent buffer zone 1 and zone
2 impacts at Impact Site 1 will result from a proposed permanent City of Durham stream easement along stream S1 for current and future protection,
access, and potential maintenance to the stream enhancement project. No permanent buffer impacts will result from the proposed sidewalk
replacement. The sidewalk will be replaced within its existing footprint, which requires temporary construction access only, resulting in temporary buffer
impacts only. Temporary buffer impacts to zone 1 and zone 2 along stream S1 will also result from the necessary temporary construction access to
complete the proposed stream enhancement. Temporarily impacted areas will be returned to pre-existing contours and planted with native vegetation
upon completion of the proposed work as shown in the Planting Plan Set attached as part of this permit application.
E. Impact Justification and Mitigation
0
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The proposed enhancement and stabilization of stream S1 has been designed to improve the water quality functions of the streams and the associated
floodplain, enhance and protect the natural ecosystem and riparian community, control and reduce future streambank erosion, restore aquatic habitat,
while also promoting long-term stability of the sidewalk and ensuring pedestrian safety. As part of the project, the sidewalk was designed to be replaced
in its existing footprint to avoid any permanent impacts from this activity. Temporary construction and staging areas for the stream enhancement and
sidewalk replacement have been located outside of jurisdictional areas to the greatest extent possible, while still allowing for the necessary access
points to construct the project.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Impacts to streams and protected riparian buffers within the limits of disturbance will be avoided throughout the construction process by equipment,
materials, and access corridors to the greatest extent possible. Where feasible, staging and construction access routes will be located in upland areas.
Silt fencing will be installed around the limits of disturbance to help ensure that all construction equipment will remain within the project limits throughout
the construction process. Sediment control measures will be used to reduce stormwater impacts to receiving waters and minimize runoff from the
construction sites. Pump-arounds or water diversion devices will be installed within the streams to allow for work in the dry. All temporarily impacted
areas will be returned to pre-existing conditions and replanted with native vegetation upon completion of construction.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State

The proposed stream enhancement serves to improve the water quality within the watershed and will not result in a loss of water; therefore, no stream mitigation is proposed. Additionally,
in accordance with the Jordan Lake Watershed Buffer Rules, buffer impacts resulting from "stream restoration" or "streambank stabilization" are considered "allowable" and, therefore, do
not require mitigation. No permanent buffer impacts will result from the proposed sidewalk replacement. The sidewalk will be replaced within its existing footprint, which requires temporary
construction access only, resulting in temporary buffer impacts only.

Comments:
Stormwater will not be concentrated, collected, or discharged as a result of the proposed stream enhancement. Additionally, as part of the stream repair, streambanks that have been
regraded and disturbed will be replanted with live stakes and bare roots and will be hand -planted with herbaceous plugs to promote vegetation establishment, restore the overall function of
the riparian buffers, and maintain diffuse flow (see Planting Plan Set attached as part of this permit application). Pavement removed is being replaced within its existing footprint, resulting
in no addition of impervious surfaces.

As of August 18, 2023, the US Fish and Wildlife Service (USFWS) Information for Planning and Consulting (IPaC) tool lists three protected species with
potential to occur within the project vicinity. The USFWS IPaC database tool also identifies tricolored bat as a species proposed for listing as endangered
with potential to occur in within the project vicinity. Kimley-Horn reviewed the NC Natural Heritage Program (NCNHP) element occurrence database
(updated July 2023) to determine if there are any known occurrences of federally protected species within the project study area or its vicinity. The
NCNHP database records indicate that there are no known occurrences of any federally protected species within the project study area.
The Tricolored bat is currently proposed for listing and is not currently protected under the Endangered Species Act (ESA). A review of the NCNHP
database records (updated July 2023) indicates that there are no known occurrences of the tricolored bat in or within 1.0 mile of the project study area. If
listed prior to construction of the project, the City of Durham will coordinate with the USFWS as appropriate.
Potentially suitable habitat for Michaux's sumac is present along the maintained lot edges, sidewalk shoulders, and roadside within the project study
area. Although these areas provide potentially suitable habitat, the regular mowing maintenance schedule and herbicide application, shading, and
invasive species overgrowth observed within these areas would likely inhibit the plant's success. Additionally, a review of the NCNHP database records
(updated July 2023) indicates there are no known occurrences of Michaux's sumac in or within 1.0 mile of the project study area. Due to the lack of
suitable habitat and lack of known occurrences within the project study area, it has been determined that the proposed project will have "No Effect" on
Michaux's sumac.
Potentially suitable habitat for smooth coneflower is present along the maintained lot edges, sidewalk shoulders, and roadside within the project study
area. Although these areas provide potentially suitable habitat, the regular mowing maintenance schedule and herbicide application, shading, and
invasive species overgrowth observed within these areas would likely inhibit the plant's success. A review of the NCNHP database records (updated
July 2023) indicates no known occurrences of smooth coneflower within the project study area, however, there is one known occurrence of smooth
coneflower within 1.0 mile of the project study area. Due to the lack of suitable habitat and the lack of known occurrences within the project study area, it
has been determined that the proposed project will have "No Effect" on smooth coneflower.
Suitable habitat for the Atlantic pigtoe is not present within stream S1 within the project study area. Stream S1 is an urban, perennial stream that has
eroded, unstable banks and is impacted by sediment discharge. Stream S1 is also lacking hydrological in -channel structures, such as riffle -pool
complexes, and grade control. Stream S1 is likely not well -oxygenated due to the lack of these riffle -pool complexes, the little variation within the stream
profile, and the influence of sedimentation within the stream. Additionally, the nearest known population of Atlantic pigtoe is located approximately 49.5
miles downstream in the Cape Fear River. Stream S1 is separated from the nearest known Atlantic pigtoe population by B. Everett Jordan Lake. A
review of the NCNHP database records (updated July 2023) indicates there are no known occurrences of Atlantic pigtoe in or within 1.0 mile of the
project study area. Due to the lack of suitable habitat and the lack of known occurrences within the project study area, and the lack of connectivity to
known populations, it has been determined that the proposed project will have "No Effect" on the Atlantic pigtoe.
