The project proposes to repair, stabilize, and enhance two sections of stream S1 along the southern side of Lakewood Avenue between the intersection of University Drive and South Duke Street and South Roxboro Street (Figure 1) to improve the water quality functions of the stream and floodplain in Durham, NC. This will be completed through the enhancement of the natural ecosystem and riparian community, control and reduction of streambank erosion, and improvement of aquatic and terrestrial habitat. Additionally, portions of the existing sidewalk adjacent to stream S1 will be replaced within its existing footprint to improve pedestrian safety and reduce future erosion in the stream channel as part of the repair and stabilization of the eroding banks of stream S1. Note, the property parcel information included in the attached Figure 5 and the associated Property Parcels Table was obtained from Durham County Property Parcels and the City of Durham GoMaps Interactive GIS mapper. However, the property parcel/owner information for 112 Hillside Avenue was provided by the City of Durham, who was informed that the parcel would be under new ownership. The updated owner information for this parcel is not yet reflected in Durham County Property Parcels and the City of Durham GoMaps Interactive GIS mapper but is reflected in the attached Figure 5 and the associated Property Parcels Table included in this permit application. Kimley-Horn staff delineated the project corridor on June 1, 2020 and June 20, 2023 identified 4 streams within 50 feet of the project corridor (S1, S2, S3, and S4) (Figure 3). A Preliminary Jurisdictional Determination Request for the Lakewood Avenue Stream Stabilization and Enhancement project has been attached as part of this permit application. Additionally, small portions of the project corridor overlap with an existing Preliminary Jurisdictional Determination (SAW-2021- 00554) that was issued by April Norton of the USACE on May 13, 2021. A Buffer Determination Kim ey>>> Horn Page 2 (NBRRO# 21-67) was issued by Cheng Zhang of the NCDWR on April 29, 2021 that confirmed streams S1-S4 and determined the applicability of protected riparian buffers for those features. The above referenced determinations are included as part of this permit application package. The proposed stream enhancement will result in 1,271 linear feet (0.42 acres) of unavoidable permanent, no net loss of water impacts to an unnamed tributary (stream S1). Stream repair and enhancement activities will include the grading of damaged and unstable stream banks to match natural channel contours, the placement of rip rap, rock toe protection, and brush toe protection along the stream banks to provide stabilization. These enhancement activities will also include the installation of cross vanes, step pool structures, rock and roll riffles, and log J-hook riffles within the stream to establish grade control, reduce streambank erosion, facilitate sediment transport, and enhance aquatic species habitat. Proposed temporary impacts to stream S1 will result from temporary access to facilitate construction/installation of stream enhancement structures and streambank repair, and for temporary dewatering via pump -around to allow for work in the dry. Temporary construction access will result in 46 linear feet (0.02 acres) of temporary impacts to stream S1. Upon completion of the project, temporary impacts will be returned to pre-existing conditions. The proposed stream enhancement will result in permanent and temporary impacts to the Jordan Lake Watershed buffer zones along stream S1. Stream enhancement activities including the grading back of stream banks and the installation of structures to promote function and prevent future erosion of stream S1 within the limits of disturbance (LOD). Outside of the LOD, permanent buffer zone 1 and zone 2 impacts at Impact Site 1 will result from a proposed permanent City of Durham stream easement along stream S1 for current and future protection, access, and potential maintenance to the stream enhancement project. These stream enhancement activities and permanent City of Durham stream easement will result in 51,394 square feet of permanent buffer zone 1 impacts and 3,854 square feet of buffer zone 2 impacts. No permanent buffer impacts will result from the proposed sidewalk replacement. The sidewalk will be replaced within its existing footprint, which requires temporary construction access only, resulting in temporary buffer impacts only. Temporary buffer impacts to zone 1 and zone 2 along stream S1 will also result from the necessary temporary construction access to complete the proposed stream enhancement. Temporary construction access will result in 21,607 square feet of temporary buffer zone 1 impacts and 13,659 square feet of temporary buffer zone 2 impacts along stream S1. Temporarily impacted areas will be returned to pre-existing contours and planted with native vegetation upon completion of the proposed work as shown in the Planting Plan Set attached as part of this permit application. No compensatory mitigation is proposed as part of this permit application. The proposed stream enhancement will serve to improve the water quality within the watershed and will not result in a loss of water; therefore, no stream mitigation is proposed. Additionally, in accordance with the Jordan Lake Watershed Buffer Rules, buffer impacts resulting from "stream restoration" or "streambank stabilization" are considered "allowable" and, therefore, does not require mitigation. No permanent buffer impacts will result from the proposed sidewalk replacement.
