THAT, further the property of Grantor and Grantee is subject to Storm Water Permit Number SW8 070323; THAT, Grantee accepts that property subject to the terms and conditions as contained in Storm Water Permit Number SW8 070323 and will seek to have said permit modified to accommodate any and all plans it may have for the future development of the above -described tract. Grantor will cooperate with Grantee in having said permit modified so that the property still retained by Grantor may be used pursuant to its current use and that modification to the permit will be made to accommodate future improvements to the property of Grantee; THAT, Grantee further acknowledges by acceptance of this deed that the existing storm water pond on the property herein conveyed to Grantee will receive the storm water runoff from Grantor and that in addition to the reservations above Grantor reserves a maintenance easement of five (5) feet on each side of the line leading to the pond from the retained property of Grantor and the maintenance of the pond shall be the sole and separate responsibility of Grantee; TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances thereto belonging to the Grantee in fee simple. And the Grantor covenants with the Grantee, that Grantor is seized of the premises in fee simple, has the right to convey the same in fee simple, that title is marketable and free and clear of all encumbrances, and that Grantor will warrant and defend the title against the lawful claims of all persons whomsoever, other than the following exceptions: Grantor covenants with Grantee that Grantor has seized the premises in fee simple and has the right to convey same in fee simple and that the title is marketable and that Grantor has done nothing since its ownership of the property to encumber the property in any manner other than the Storm Water Permit as hereinabove set forth.
