Tryon Street Development. The project authorized impacts to 650 linear feet of stream channel. To compensate for the unavoidable loss to aquatic resources, the applicant chose to purchase 650 stream mitigation units (SMUs) from the North Carolina Division of Mitigation Services (NCDMS). In addition, the applicant also chose to relocate and restore approximately 900 linear feet of on -site stream channel. This letter also references your permit modification request dated September 15, 2023, requesting a design modification within the on -site channel relocation/restoration reach. The June 8, 2023, DA permit verification authorized the use of a culverted crossing in this location. Your September 15, 2023, permit modification is requesting authorization to use a 70-foot timber pile bridge. There would be no impacts to waters of the United States in conjunction with this permit modification, but rather, additional measures of avoidance and minimization. Following evaluation of the information submitted in your modification request, the U.S. Army Corps of Engineers, Wilmington District has determined that it is appropriate and reasonable and not contrary to the public interest, and no public notice is required for this modification. Therefore, the permit is modified to include the requested 70-foot timber pile bridge. Accordingly, Permit Condition 1 of your permit is hereby modified to read: "Work Limits: All work authorized by this permit shall be performed in strict compliance with the attached permit plan entitled Embrey North Tryon (C3-00, C3-01 and C3-02), dated 8/30/2022 and 1012812022; 3027 North Tryon Stream Restoration IN and dated 511812023; and Site Layouts (100, 101, and 201), which is a part of this permit. The Permittee shall ensure that the construction design plans for this project do not deviate from the permit plans attached to this authorization. Any modification to the attached permit plans must be approved by the U.S. Army Corps of Engineers (Corps) prior to any active construction in waters or wetlands. " All other conditions of the DA permit modification issued on June 8, 2023, remain in effect as written.
