Good Morning Kim,
DWR has additional questions regarding avoidance and minimization and completeness of the
overall development plan. In accordance with 15 A NCAC 02H .0506 (b)(1) the Division shall evaluate
if the proposed activity: has avoided and minimized impacts to surface waters and wetlands to
ensure any remaining surface waters or wetlands, and any surface waters or wetlands downstream,
continue to support existing uses during and after project completion. The DWR is placing your
application on hold until such time as the following requested additional information has been
provided to complete the review:
1. Avoidance and minimization; the impacts associated with this application request are greater
than those previously proposed in the ePCN application submitted on 2/7/2022. Please justify
the needed increases in impacts. Including open water impacts 4 and 5.
2. The previous application submission included impacts associated with widening an existing
crossing labeled "A" on the attached map, please clarify why this and the impact labeled "D"
have not been accounted for in this application.
3. Provide rip rap apron details and impacts where proposed.
Please note, DWR received the application fee as required by 15A NCAC 02H .0502 (State application
completeness requirements) on 6/26/2023 which started the 60-day State review clock. The DWR
has requested additional information as listed above and in accordance with 15A NCAC 02H .0507

I've had a chance to revie this PCN application, please see my review comments below:

This previous application was withdrawn by NCDEQ for being incomplete. How has this new
application addressed the 2022 application issues or how do the impacts differ?

installed at the culvert outlets?

Directional Bore under Shallotte River
The Shallotte River is listed as a Section 10 water (11 miles of it) I don't think it has a Section 408
designation for previous Corps dredge work. (I'll check with Corps 408 Section)
Based on the profile/diagram for the Directional Drill work (page 31), 1 can't tell where the actual
stream/river is on the profile plan. It looks like it might be between section 25+ and 26+? I'll need to
know how deep the line will go under the river bed for potential future dredge work, navigation, etc.
NLEB in IPAC
I've joined the project in IPAC, I'll get the Concurrence Letter to USFWS this week.
RCW Slopes
A RCW Slopes agreement was filled out for the previous 2022 NWP application.
These are some of my comments that I noticed looking through the project application today. There
may be additional comments at a later date.
