Please see below a response to both of your comments (in red).
NCDWR Comments:
1. Avoidance and minimization; the impacts associated with this application request are
greater than those previously proposed in the ePCN application submitted on 2/7/2022. Please
justify the needed increases in impacts. Including open water impacts 4 and 5.
The original site plan submitted in 2022 was prepared with limited survey information and
was not fully engineered. Detailed survey information for Phase 1 has now been gathered and
fully designed. With this additional information, it was determined that Crossings W 1, W2,
OW I, and OW2 (previously shown as OW 4 and 5) needed to be wider than previously
shown.
2. The previous application submission included impacts associated with widening an existing
crossing labeled "A" on the attached map, please clarify why this and the impact labeled "D"
have not been accounted for in this application.
This project has been divided into phases and this application includes Phase 1. Crossings A
and D will be part of Phase 2 and have not yet been fully designed. These crossings have been
removed from the overall site plan to avoid confusion (Sheet 1). If additional impacts are
needed in Phase 2, another Section 404/401 permit application will be submitted and impacts
will be looked at cumulatively with impacts in Phase 1.
3. Provide rip rap apron details and impacts where proposed.
The engineer confirmed that rip rap is not needed at Crossings W 1 and W2. However, it will
be needed at crossings OW1 and OW2. The site plan drawings (Sheets 1, 4, & 5) have been
revised to show this. Note that although ditch impacts have increased slightly to account for
the rip rap, it still falls within the area of estimated permanent impact that was previously
shown in the PCN (0.02 ac).

1. Previous NCDEO 401 Denial letter from June 6, 2022
This previous application was withdrawn by NCDEQ for being incomplete. How has this
new application addressed the 2022 application issues or how do the impacts differ?
The 401 WQC was denied in 2022 because NCDWR requested road crossing specifications
and the applicant could not provide that information at that time. This project has now been
split into phases. The engineer recently designed Phase 1, which includes two wetland
crossings and another road that will provide access to a proposed pump station. This
application also includes temporary impacts related to a sewer and water lines that will be
installed from Washington Road to the north.
Other wetland/stream crossings are anticipated in future phases, but the developer is not
ready to perform detailed engineering for these future phases. Once the developer is able to
design these phases, impacts will be looked at cumulatively with the impacts in this
application.

Page 23, looks like the small finger for this wetland will be filled, will energy dissipators/rip
rap be installed at the culvert outlets?
The engineer confirmed that no rip rap is needed at this crossing.
3. Open water impacts #1, 2, 3, &4
Will there be pipes/culverts installed under the proposed road to keep water flowing through
the ditches?
OW impacts 1 and 2 are road crossings and culverts will be needed. Sheets 4 and 5 have
been revised to show the culverts and rip rap.
OW Impacts 3 and 4 are temporary utility line crossings. No culverts will be needed here.

Page 27, Will there be a pipe/culvert installed under the proposed road to keep water
flowing through the ditch? Is there going to be additional work on this crossing? Additional
impacts, etc.
This crossing is in Phase 2 and is not part of the project at this point. It has been removed
from the overall site plan to avoid confusion. The existing road may need to be widened in
Phase 2 and impacts from this work would be looked at cumulatively with proposed impacts
in Phase 1.
5. Road crossing over/near D on Labelled Map (D on attached map)
Is this an additional road crossing?
Similar to Crossing A, this crossing is in Phase 2 and is not part of the project at this
point. It has been removed from the overall site plan to avoid confusion.
6. Directional Bore under Shallotte River
The Shallotte River is listed as a Section 10 water (I I miles of it) I don't think it has a
Section 408 designation for previous Corps dredge work. (I'll check with Corps 408
Section)
Based on the profile/diagram for the Directional Drill work (page 31), I can't tell where the
actual stream/river is on the profile plan. It looks like it might be between section 25+ and
26+? I'll need to know how deep the line will go under the river bed for potential future
dredge work, navigation, etc.
Sheet FM 3 has been revised to show the distance from the bottom of the river to the
proposed pipe (10 feet).
NLEB in IPAC
I've joined the project in IPAC, I'll get the Concurrence Letter to USFWS this week.
Sounds good.
RCW Slopes
A RCW Slopes agreement was filled out for the previous 2022 NWP application.
Sounds good.
These are some of my comments that I noticed looking through the project application
today. There may be additional comments at a later date.
