On August 8, 2023, the US Army Corps of Engineers, Wilmington District received your e-mail notification detailing the
impacts associated the construction of SAW-2023-01609 NCDOT WBS 49907, replacing existing culvert under Burnt Mill
Road (unnamed tributaries to West Fork Deep River) in Forsyth County, North Carolina. And supplemental information
you provided on August 15, 2023, including a photograph of the existing project site. This project will include the
replacement of the existing 52-foot-long culvert with a new culvert that is 60 feet in length. This nominal increase in
structure length is due to design improvement to stabilize the damaged inlet of the existing structure and will include
placement of an 8-foot-long or 0.001 acre added segment of culvert to include a sill for grade control at the outlet of the
proposed culvert. This project will also include the placement of a total of 43 linear feet of bank stabilization to protect
the new culvert and existing Burnt Mill Road fill slope. Also, this project will include placement of a total of 35 linear
feet or 0.003-acre temporary impacts associated with dewatering structures in unnamed tributaries to West Fork Deep
River for the removal of the existing culvert and placement of the new culvert. Plans detailing this project are attached
to this e-mail.
Based on the information provided in your application and the updated details as revised on August 15, 2023, (details of
existing site conditions including photograph) your work is authorized by Nationwide Permit (NWP) 3 Maintenance and
does not require a pre -construction notification (PCN), provided it is accomplished in strict accordance with the attached
conditions and your submitted description. Any violation of the attached conditions or deviation from your submitted
description and attached plans may subject the permittee to a stop work order, a restoration order and/or appropriate
legal action. Attached are copies of the NWP 3, and the applicable permit conditions. If the nationwide permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the
terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
This response to your notification does not relieve the permittee of the responsibility to obtain any other required
Federal, State, or local approvals/permits. As indicated in the Corps conversation with NC Department of Environmental
Quality (DEQ) personnel, this project will require an individual 401 Water Quality Certification and State Stream Buffer
Certification. Please be aware that no in -stream work is authorized under the non -reporting NWP-3 until NC DEQ
provides NCDOT with both the Water Quality and Stream Buffer Certifications. Any questions related to water quality
certification specific to this project should be directed to North Carolina Division of Water Resources.
