1.0 Introduction
1.1 Project Description
The Catfish Pond II Mitigation Bank Parcel (Parcel) is part of Wildlands Holdings V, LLC, (Sponsor) Catfish
Pond II Nutrient Offset and Buffer Mitigation Bank (Bank). The project encompasses Catfish Creek,
Mountain Tributary, UT1 and Ditch D. All streams and ditches eventually flow into Mountain Creek,
which subsequently flows into Little River, the Eno River, and then into Falls Lake. The purpose of the
Parcel is to provide riparian buffer mitigation credits and nutrient offset credits to compensate for
unavoidable impacts in the Neuse River Basin 03020201 Hydrologic Unit Code (HUC) within the Falls
Lake Watershed. The project has been planned, designed, and constructed according to the Bank Parcel
Development Package (BPDP), the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 (effective
November 1, 2015), and Nutrient Offset Credit Trading 15A NCAC 02B .0703. The Bank service area is
depicted in Figure 2.
Prior to construction, the Parcel consisted of active pasture used for cattle grazing, open fields, and
some woodlands. The Parcel was restored to provide ecological and water quality enhancements to the
Neuse River Basin by creating a functional riparian corridor and restoring the riparian buffer along
Catfish Creek, two unnamed tributaries (UT1 and Mountain Tributary), and a ditch (Ditch D).
Approximately 31.54 additional acres have been protected along the project features by the Parcel’s
permanent conservation easement. A conservation easement was recorded on the Parcel in September
2020.

The Catfish Pond II Nutrient Offset and Buffer Mitigation Parcel is a part of the Bank. The Mitigation
Banking Instrument (MBI) for the Bank was signed in August 2020.

1.4 Project Location
The Parcel is in Durham County, approximately 12 miles north of the city of Durham (Figure 1). The
project is located within the Neuse River Basin 14-digit HUC 03020201020040 and North Carolina
Division of Water Resources (NCDWR) Subbasin 03-04-01. The Parcel was restored for riparian buffer
mitigation credit and nutrient offset credit in the Neuse River Basin HUC 03020201 within the Falls Lake
Watershed (Figure 2).
To reach the Parcel from the City of Durham, travel north approximately 12 miles on Highway 501/North
Roxboro Street. The Parcel is on the left, 1/2 mile north of the North Roxboro Street’s intersection with
Patrick Road, and just south of its intersection with Mountain Creek (36°9'48.75"N, -78°54'41.24"W).
1.5 Project Design
Approximately 31.54 acres are protected in a conservation easement. The Parcel will generate 7.87
acres of Neuse riparian buffer credits and 19.04 acres of nutrient offset credits. Parcel credit generation
is shown in Figure 3. The revegetation plan for the Parcel included planting of bare root trees and
controlling invasive species growth. Bare root trees selected for the Parcel were native bottomland
hardwood species typical for Piedmont communities as defined by Schafale and Weakley (1990).
Adjacent forested areas were also used as a reference. Tree species selected for planting on the Parcel
as well as size specifications, planting density, and plant composition are detailed in Table 2.

Natural recruitment of desirable Character Tree species shall be counted towards the survival and
success rate of the restored site. “Character Trees” are defined as planted or volunteer species
identified from a survey of local vegetation on less degraded sections of the specified stream and from
reference literature that details native species. A list of Character Tree species (other than the planted
species) is included in Table 3.

2.0 Vegetation Monitoring
2.1 Success Criteria
Buffer vegetative success criteria are based upon the density and growth of Character Tree species as
defined in Tables 2 & 3. Vegetative success criteria are based upon guidelines set forth in the
Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 (effective November 1, 2015) and is defined as
a success rate equivalent to 260 live stems per acre at the end of the 5-year monitoring period.
If vegetative success criteria are not achieved based on acreage density calculations from combined
monitoring plots over the entire restoration area, or if an inspection of a buffer restoration site indicates
that portions of the Parcel do not have sufficient stem densities or are otherwise deficient,
supplemental planting shall be performed with tree species approved by NCDWR. Supplemental
planting shall be performed as needed until vegetative success criteria are met. No quantitative
measurements of herb assemblages will be required to meet the vegetative success criteria.
2.2 Description of Species and Monitoring Protocol
The quantity of monitoring plots was determined in accordance with the Carolina Vegetative Sampling
(CVS) Protocol (Level II). A total of 23 plots (10 meters by 10 meters) were established within the buffer
restoration area to measure the survival of the planted trees. Monitoring plot locations are shown in
Figure 4. GPS points were taken at each of the corners. A reference photo was taken from the southwest
corner of each plot (Appendix D). All planted stems within the plots were marked with flagging tape and
recorded. Total numbers of tree species planted within the monitoring plots as well as planting density
and plant composition are detailed in Table 4. Detailed results of the Monitoring Year 3 stem count are
summarized in Appendix C.

2.3 Results of Vegetation Monitoring
The 23 vegetation plots were sampled in September 2023 at the end of the third growing season. A
reference photo was taken from the southwest corner of each plot, which can be found in Appendix D
along with the stem count raw data. Total numbers of tree species identified within the monitoring plots
as well as density and composition are summarized below in Table 5. Vegetation result tables with
planted stem density, and stem count by plot and species are summarized in Appendix C.
The 2023 vegetation monitoring resulted in an average stem density of 507 planted stems per acre
across vegetation plots, which is well above the final requirement of 260 stems per acre. All vegetation
plots individually exceed the final stem density requirement by more than ten percent; with planted
stems per acre ranging from 324 to 607. When volunteer species are included, the average stem density
increases to 1,107 stems per acre with individual plots ranging from 405 to 2,711 stems per acre. All
plots have 5 or more planted species and most planted stems across plots have a vigor of excellent (4),

as can be seen in Appendix D. Volunteer stems include desirable species, such as American persimmon
(Diospyros virginiana), green ash (Fraxinus pennsylvanica), sycamore (Platanus occidentalis), and elms
(Ulmus spp.).
Vegetation Plots 1, 8, 10, 11, 13, and 22 all contain twenty or more volunteer sweet gum stems (Table 7,
Appendix C). However, their presence does not seem to be adversely affecting planted stems. The
average planted stem height across the six plots ranges from 157 cm to 285 cm, while the majority of
sweet gum volunteers in the plots fall into height categories below 137 cm. Additionally, planted stem
densities are well above the requirement and tree vigor ratings show healthy stems (Appendix D).
Wildlands will continue to observe areas with sweet gum volunteers.

2.4 Parcel Adaptive Management
While planted trees are growing well, herbaceous vegetation is dense. In May 2023, another round of
herbicide ring sprays were applied around the base of trees, targeting those waist high or less in height.
Soil amendments were also added to the base of these stems to give them an advantage in competing
for resources, therefore helping them grow above herbaceous vegetation. Soil amendments consisted of
a mix of nutrients and lime to help neutralize soil, making it easier for roots to absorb those nutrients.
In March 2023, invasive and aggressively growing species were treated using various approaches along
the downstream reaches of Catfish Creek. Resprouts of Chinese Privet (Ligustrum sinense) were treated
through a cut stump herbicide application or hand pulled. Sporadic patches of multiflora rose (Rosa
multiflora), Japanese honeysuckle (Lonicera japonica), and competing blackberry (Rubus spp.) were
treated with a foliar spray of triclopyr. Wildlands will continue to monitor for invasive species and
additional treatments will be applied as necessary.
Adaptive measures will be developed, or appropriate remedial actions will be implemented in the event
the Parcel, or a specific component of the Parcel fails to achieve the success criteria outlined in the
BPDP. Parcel maintenance will be performed to correct any identified problems that have a high
likelihood of affecting project success. Such items include but are not limited to; excess tree mortality
caused by fire, flooding, drought, or insects. Any actions implemented will be designed to achieve the
success criteria and will include a work schedule and updated monitoring criteria.
2.5 Conclusions
Vegetation across the Parcel is exceeding performance standards and on track to achieve the final
success criteria of 260 stems per acre at the end of Monitoring Year 5. Monitoring Year 3 data shows an
average density of 507 planted stems per acre across vegetation plots, with individual plots ranging from
324 to 607 planted stems per acre. When including volunteer species, the average stem density
increases to 1,107 stems per acre with individual plots ranging from 405 to 2,711 stems per acre.

Desirable volunteer species, such as American persimmon (Diospyros virginiana), green ash (Fraxinus
pennsylvanica), sycamore (Platanus occidentalis), and elms (Ulmus spp.) are establishing themselves.
Herbaceous vegetation is also flourishing across the Parcel. Invasive species do not appear to be
negatively affecting desirable vegetation. Wildlands will continue to monitor the health of planted trees
and invasive species, managing issues as necessary.
