Dear Ms. Elks and Mr. Turlington:
On behalf of our client, Gray Wolf Property, LLC, application for authorization under Nationwide Permit
(NWP) #29 and corresponding Individual 401 Water Quality Certification for the Kelly Farms project located
in Harnett County, North Carolina. The project proposes to construct a single-family residential
development consisting of approximately 51 individual lots and associated interior publicly accessible
roadway corridors to facilitate access into and throughout the development. No impacts to jurisdictional
features will result from grading of the single-family lots or construction of the residences, which will be
designed individually. The proposed residential development will provide additional residential areas near
Lillington, North Carolina. The approximately 56-acre project study area includes a single property parcel
located along US Route 421 and Old US 421 and is situated generally west of the City of Lillington. The
project study area currently exists as a mix of agricultural land and undeveloped forested riparian corridors,
with some internal access roads transecting the parcel. The project vicinity is primarily composed of
maintained roadway corridors, scattered single-family homesites, undeveloped forestland, riparian
corridors, and agricultural/pastural fields. The permit applicant, Gray Wolf Property, LLC, is under option to
purchase the project parcel.
Kimley-Horn staff delineated the project area on March 30, 2023 and identified nine wetlands (W1-W9),
two streams (S1 and S2), and one pond (P1). A Preliminary Jurisdictional Determination Request for the
project is attached as part of this permit application package.
Impacts to the wetlands, streams, and ponds within the project study area have been avoided and
minimized to the extent practical throughout the careful design of the residential development and
alignment of the associated internal roadways. The proposed individual lots were deliberately configured to
make use of upland areas throughout the project and avoid impacts to jurisdictional waters. The proposed
internal roadways within the development are located primarily in uplands and result in a single stream and
wetland crossing only to facilitate access to the western portion of the project. The roadway crossing,
Street C, has been intentionally aligned to cross stream S2 and wetland W7 as close to perpendicular as
practicable to minimize impacts to these jurisdictional features.
At Impact Site 1, unavoidable permanent and temporary impacts to stream S2 are proposed for the
construction of a new internal roadway, Street C, to facilitate connection throughout the residential

development. The construction of this new roadway within the development will permanently impact 33
linear feet (0.003 acre) of stream S2 due to the installation of a culvert under Street C and associated
grading. An additional 31 linear feet (0.003 acre) of permanent stream impacts that will result in no net loss
of waters to stream S2 are proposed at the culvert inlet and outlet. At both the culvert inlet and outlet,
riprap will be keyed -in to the bank and countersunk into the bed of stream S2 to provide outlet protection
and prevent future erosion, while still allowing for normal flow and the movement of aquatic species. To
allow for temporary construction dewatering and access, 64 linear feet (0.006 acre) of temporary stream
impacts to stream S2 are proposed. All temporarily disturbed areas within the stream will be returned to
pre -construction contours after completion of the project.
At Impact Site 2, unavoidable permanent and temporary impacts to wetland W7 are proposed for the
construction of a new internal roadway, Street C, to facilitate connection through the development. The
construction of this new roadway within the development will permanently impact 0.027 acre of wetland W7
due to the installation of a culvert and associated grading. An additional 0.008 acre of temporary impact to
wetland W7 are proposed to allow for temporary construction access. The culvert has been designed to be
situated along the low point of the wetland to allow for natural aquatic connectivity throughout wetland W7.
Compensatory mitigation for stream and wetland impacts has not been proposed as part of this permit
application due to the minimal permanent stream impacts (<0.02 acre) and minimal permanent wetland
impacts (<0.1 acre) resulting from the residential development project.
