(Stantec) is pleased to submit this response to the North Carolina Department of Environmental Quality (DEQ) Division of Water Resources' (DWR) email request for additional information dated September 14, 2023. Your questions are presented first, followed by our answers in italics. The responses provided indicate that the width of the proposed roads, and therefore the permanent stream impacts, are because of utility line installation and spacing requirements. It would appear that further avoidance and minimization could be accomplished by proposing burial of the utilities (some or all) under the stream channel. This would allow for temporary impacts to the streams for the purpose of utility installation, and permanent impacts to be reduced to the minimum necessary for the vehicular road only. Please either modify the application in this manner or provide sufficient justification for the permanent loss of streams for the purpose of utility installation. Please note that the agencies regularly receive applications for a wide variety of utility installation projects, including large interstate energy pipelines, where installation is proposed as temporary impacts, therefore any justification for permanent impacts should be related to unique aspects of this project rather than constructability, cost, east of future maintenance, or any other activity that would be expected for other types of utilities. • Response: Duct banks, water lines, sanitary sewers and storm sewers are necessary utilities on data center sites. When possible, these utilities are collocated within proposed road crossings to minimize the need for additional crossings and impacts from utilities. Impacts SE1-SE5 Road Crossing — The project proposes one road crossing of jurisdictional features, north off NC highway 16, to provide a maintenance road to Best Management Practice (BMP) #1. The roadbed features multiple utilities to include; 49-inchx 41-inch fiber duct, 8-inch domestic waterline, 12-inch fire line, and also provides a 5-foot wide concrete sidewalk on either side as depicted in the cross section in Figure 2 below. All utilities are contained within the footprint of the proposed impact for the road construction. The roadway is required to provide access to the BMP#1 and even if the utilities were not proposed within the roadbed, the impacts to jurisdictional impacts in this location would not change. The width of the fill is based on the width of the roadway and sidewalk, topography, rise/run of the side slopes, use of headwalls, and scour protection and not the placement of utilities. Profile of Impacts SE1-SE5 This roadway crosses the existing stream perpendicularly to minimize impacts. The stream is small, with steep slopes on both sides. The roadway is bounded by the property line to the west and the proposed BMP to the east. Offsite stormwater drainage from the adjacent residential development outfalls in this location on the property line. Moving the roadway and the utilities to the east is not possible due to the location of the BMPs which are constrained by the stream location, a retaining wall to the north and the eastern property boundary. The duct banks cannot be moved to the west due to the property line location. BMP #1 cannot be moved without impacting the existing stream and creating conflict with the proposed retaining wall to be installed further upstream to avoid impacts. The existing road access for the CLT08 pad site is not within the property boundaries and therefore would not be within the secure perimeter. Additionally, the road and crossing is not wide enough to accommodate both duct banks with 65 feet of separation. Because of this, the designer is unable to collocate utilities within the existing roadbed over Lyle Creek. As no roadway crossings are proposed over Lyle Creek, the designer is proposing two temporary impacts for fiber crossings. Impact SC1 and SC2 —As no new road crossings of Lyle Creek are proposed within the project boundary, two duct bank crossings of Lyle Creek are necessary. Both proposed fiber crossings of are necessary to provide redundant pathways to the CLT08 building. At both locations, the crossings were selected perpendicular to the stream to reduce the temporary impacts to the stream and minimize grading of the creek banks. Site Layout at Impact SC2 2. You have stated that the stream impacts proposed at location SF1 are required for the installation of the outfall for BMP#8. You indicate that only 4 LF of riprap will be in the stream, however the impact length is proposed as 34 linear feet. It appears that the outfall for this BMP could be located further back from the stream and provide all energy dissipation requirements prior to the streambank, or that an alternative energy dissipation method, such as a preformed scour hole could be utilized to avoid stream impacts at this location. Please revise the stormwater plans accordingly or provide a clear justification for why all other possible alternatives for energy dissipation are not technically feasible at this location. Please note that the Division reviews many stormwater BMPs annually which are able to provide required energy dissipation outside of the limits of jurisdictional features. Response: The Jurisdictional Impacts Map has been revised to remove the impact SF1. BMP #8 outlet pipe and rip rap have been modified to keep the footprint above the top of the stream bank and not impact the channel. The overall temporary impacts and conversion impacts remain the same. The permanent impacts decreased from 889 LF to 855 LF of stream. The Preferred Alternative will now result in permanent impacts to 855 LF (0.07 AC) stream channel and 0.08 AC of wetlands, conversion impacts to 0.19 AC of wetlands, temporary impacts to 229 LF (0.07 AC) of stream channel and indirect impacts to 140 LF of stream (0.013 ac). An updated set of Jurisdictional Impact Maps is provided in Attachment 1. Table 1 below summarizes the revised impact numbers.
