On July 31, 2015, the Division of Water Resources (Division) received your application dated
July 29, 2015 requesting a 401 Water Quality Certification and Riparian Buffer Authorization
from the Division for your project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until the following
information is received:
1. The application is incomplete since a number of questions are left blank. The following
sections need to be completely filled out: [15A NCAC 02H .0502(b)]
• Section A. Applicant Information
• Section E. Stormwater Management and Diffuse Flow Plan
• Section F.3. Cumulative Impacts
2.' In addition to incomplete information in Section E. Stormwater Management and
Diffuse Flow Plan, there is conflicting information. The application states that a
stormwater management plan (SMP) is required, but the site plan does not show any
stormwater best management practices. If the City of Raleigh is not requiring a SMP,
then documentation needs to be included in the application to explain why. Also, if the
City of Raleigh is not requiring a SMP, then the application needs to include a diffuse

flow plan that the Division will review since this project is in the Neuse River Basin and is
subject to Neuse Riparian Buffers. [15A NCAC 02H .0506(b)(5) and (c)(5)]
3. The site plan is labelled "Sketch Site Plan ", and that accurately describes what was
submitted with the application. The site plan needs to locate all wetlands and streams
as overlays. The stream is currently depicted as a line, but given that it is a perennial
stream, it should be shown as having dimension with the buffers measured from each
streambank. Riparian buffers need to also be located as overlays on the site plan clearly
showing Zones 1 and 2. Producing a legible site plan for this project will likely require
full -size plan sheets. In addition, it should show the entire property and be dated and
stamped by a professional engineer. [15A NCAC 02H .0502(b)]
4. It is difficult to tell from the plans that were submitted whether the culvert is buried the
appropriate depth to allow aquatic life passage that is a requirement of the 401 Water
Quality Certification. Please make sure this requirement is clear with the next submittal.

Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 0213 .0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699 -1617.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity.
