RAWLS Director MEMORANDUM: TO: Cameron Luck, Assistant Major Permits Coordinator FROM: Kimberlee Harding, NCDMF Fisheries Resource Specialist SUBJECT: Lawrence and Mary Alderson DATE: September 18, 2023 A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the CAMA Permit application for proposed actions that impact fish and fish habitats. The project site is located at 5916 Nautical Isle Court, within the Helms Port Subdivision adjacent to Masonboro Sound, in Wilmington, New Hanover County. The applicant proposes to install a private, three -slip docking facility. The waters of the AIWW are classified SA-ORW by the Division of Water Quality, are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries (DMF) and are closed to the harvest of shellfish. The proposal includes two formalized boat slips and a floating dock for the third formalized boat slip. The applicants states that the project footprint is sited in-2'-2.2' NLW. However, the DCM representative collected water depths and found the project site depths are approximately -1' NLW after two separate site visits. The Division reviewed the date and time the applicant conducted their water depth survey and found that measurements were taken at a higher than predicted tide cycle. The DCM representative conducted their water depth survey on a more appropriate tide cycle. The depths the DCM representative found are consistent with other docking facilities adjacent to this project site and no other docking facility on Nautical Isle Court includes a floating structure. Therefore, since the project is proposed in water depths less than -2'NLW and is located within a PNA, the Division recommends the removal of the proposed floating dock and including limit switches on the boat lifts at 18" above the substrate.
