Dunn, Coastal Coordinator Habitat Conservation Division DATE: September 15, 2023 SUBJECT: CAMA Dredge/Fill Permit Application for Michael Slater and Barry Rogstad, Currituck County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 2172 Mobjack Terrace and 2170 Mobjack Terrace in Corolla, NC adjacent Knotts Island Bay. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. I I3A-100 through I I3A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicants propose to install 152' of vinyl bulkhead an average of 21.5' and maximum 42' waterward the NWL of the eroded shoreline. This bulkhead is between two other bulkheaded lots and has seen significant erosion between 2012 and 2023. To provide water access, a 6' by 50' pier, a 10' by 16' platform, and a 14' by 14' boat lift are also proposed. Waterdepths in the area of the slip is -3' NWL. Knotts Island Bay in this area is classified SC by the Environmental Management Commission. The NCWRC has reviewed the permit application and does not have concern with the proposed water access structures. However, the bulkhead alignment is rather forward the NWL of the eroded shoreline. While it is understood significant area has been eroded, the erosion has occurred over a number of years. To minimize impacts to shallow water habitats that have developed in this area, we request minimization of the bulkhead extension be considered. The NCWRC appreciates the opportunity to review and comment on this permit application.
