with the RES Pasquotank Umbrella Mitigation Bank, White Hat Mitigation Site

Dear Mr. Carroll:
This letter is to inform you that the Wilmington District, Corps of Engineers (Corps)
has reviewed the as-built baseline monitoring report for the RES Pasquotank Umbrella
Mitigation Bank (UMB), White Hat mitigation site (Action ID SAW-2018-02027), dated
June 2023.The White Hat site is in the Pasquotank River Basin (Hydrologic Unit Code
03010205), located on Godfreys Lane, approximately nine miles east of Hertford, in
Perquimans County, NC.
In accordance with Sec. 332.8(o)(9) of the Federal Mitigation Rule, the baseline
monitoring report was provided to the North Carolina Interagency Review Team
(NCIRT) for review and comment on June 15, 2023. A site meeting was also held on
August 03, 2023, to assess the as-built site conditions. The attached minutes document
result of the meeting and comments from the NCIRT. During this meeting, several
action items were identified that need to be addressed prior to the submittal of the Year
1 annual monitoring report and credit release request. These items are noted on the
attached memo.
Pursuant to the UMB Instrument approved on November 18, 2021, and the site-
specific White Hat Final Mitigation Plan dated July 2021, 15 percent of the mitigation
site’s total restoration and enhancement credits shall be available for sale immediately
after the completion of implementation of the mitigation plan and Corps approval of the
baseline monitoring report and as-built survey. By copy of this correspondence, we
confirm that you have satisfied the above requirements for the as-built credit release,

and 1,100.970 stream mitigation units (SMUs) and 1.203 wetland mitigation units
(WMUs) are now available for sale. Please be advised that due to a change in
easement boundary during As-built, total credit amounts have decreased from
7,363.663 to 7,351.733 SMUs and from 8.470 to 8.434 WMUs. This change resulted in
1.79 extra SMUs and 0.011 extra WMUs being released in Task 1 due to the higher
credit totals in the approved Mitigation Plan. The requested credit amounts for As-Built
reflect this change in total credit, and account for the extra credits released in Task 1.
With this release, 1,100.970 SMUs and 1.203 WMUs (30 percent of the total restoration
and enhancement credits) have been released for sale.

3 - A 10% reserve of credits to be held back until the bankfull event performance standard has been met.
1 - The first credit release milestone is based on the potential credits stated in the approved mitigation plan.
2 - The first credit release shall occur upon establishment of the mitigation bank, which includes the following criteria:
1) Execution of the MBI or UMBI by the Sponsor and the USACE;
2) Approval of the final Mitigation Plan;
3) Mitigation bank site must be secured;
4) Delivery of the financial assurances described in the Mitigation Plan;
5) Recordation of the long-term protection mechanism and title opinion acceptable to the USACE;
6) 404 permit verification for construction of the site, if required.

monitoring report

1. Wetland H currently has 2 permanent veg plots; recommend changing one of the
plots to a random transect or capturing the area with a random transect
periodically during monitoring.
2. Add a photo point on the floodplain erosion at the outlet of Swale B and a photo
of the Swale B looking towards the ESP.
3. Add a photo point with a view of the riffle adjacent to VP1, which had an
excessive amount of rock in the channel.
4. Add a random plot in Wetland Area H during a future monitoring year.
