Pond#11: The proposed change is to reconfigure the pond such that the forebay moves from the south side to the north side of the pond. The letter indicates that the forebay volume is maintained between the pond currently permitted and the proposed pond. This is a substantial change from the current design and many variables are likely to have been changed. For instance, the current permit uses Option 2 for determining the average depth. Variables used in that calculation include the surface area of the bottom of the shelf, the surface area of the permanent pool, and the surface area of the bottom of the pond. All of these variables will likely change by the proposed reconfiguration. The appropriate method of making such substantial changes is through a permit modification rather than a revision. This plan revision does not change any contour surface areas below or above the normal pool. The table below shows the contour surface areas that were originally permitted and the contour surface areas in the proposed plan revision. The project will continue to be permitted under the 1995 rule as long as there is no "...increase[in]the net area of built upon area within the project site or[no]increase[in]the overall size of the stormwater controls that have been previously approved,"per SL2008-211, Section 2(d)(5). You are not proposing to increase the impervious area or the size of the pond, but please note that if the overall size of the pond were to increase it would be permitted under the 2008 Coastal Rule (SL2008-211). Vested rights have been established for Ocean Ridge Plantation Phase VI in accordance with G.S. 153A-344.1. A Planned Unit Development(PUD)Master Plan was approved for all of Ocean Ridge Plantation Phase VI by the Town of Sunset Beach on June 15, 2006 and extended on June 26,2008. Copies of the approval letters are enclosed. Based on Session Law 2008-211 (Senate Bill 1967),the entire project is vested;therefore, all permitted phases and future phases are only subject to the 1995 Coastal Rule(15A NCAC 2H .1005, effective September 1, 1995). In addition,we are not proposing to increase the built upon area or expand the size of the treatment system. This is a substantial change from the current design and many variables are likely to have been changed. For instance, the current permit uses Option 2 for determining the average depth. Variables used in that calculation include the surface area at the bottom of the shelf, the surface area of the permanent pool, and the surface area of the bottom of the pond. All of these variables will likely change by the proposed reconfiguration. The appropriate method of making such substantial changes is through a permit modification rather than a revision. 3. Rule subject: The permit is currently issued under the 1995 Coastal Rule (15A NCAC 2H .1005, effective September 1, 1995). The project will continue to be permitted under the 1995 rule as long as there is no, "...increase [in]the net area of built upon area within the project site or[no] increase [in]the overall size of the stormwater controls that have been previously approved," per SL2008-211, Section 2(d)(5). You are not proposing to increase the impervious area or the size of the pond, but please note that if the overall size of the pond were to increase it would be permitted under the 2008 Coastal Rule (SL2008-211). The primary intent of this plan revision is to reverse the direction of Pond 11 as a result of discrepancies between the drainage easements shown on the approved stormwater plans and those shown on the recorded Maps for Record. Pond 11 was originally permitted with the forebay on the south side of the pond and the main pool and outlet on the north side of the pond.As a result of this revision the forebay is now on the north side of the pond and the main pool and outlet are on the south side of the pond. Please note that the forebay grading under the normal pool has been revised such that the modified forebay volume matches the originally permitted forebay volume. Therefore,the originally approved calculations and supplements still apply and there is no change to the permitted values or functionality of this water quality pond. Additionally,this plan revision modifies several pond outlets in order to meet Brunswick County stormwater attenuation requirements. Please note that the proposed changes to the outlet structures do not in anyway affect the permitted water quality ponds as all orifice sizes and elevations and all temporary pool elevations remain unchanged. The revised outlets are reflected on the modified plan set included with this plan revision submittal. This project is vested under the 1995 Coastal Stormwater rules and the pre/post requirements do not apply.
