DMS can accept the mitigation required for the impacts listed in this letter- so I think this covers the revised amount of credit. The project is inside the Falls Lake Watershed, and I forgot to add that to my letters and apparently RS missed it on Debbie's email request. Per Debbie's email this morning, she would like me to add the 40,184.1 credits from RS to the previous DMS total (30,651.67 credits) since they do not have any credits in Falls Lake. This would be a total of 70,835.77 credits from DMS. Can you confirm that DMS is willing to accept this new amount?: September 12, 2023 Permittee: Charlie Yokley & Lennar Corp. — Raleigh Division DWR Project # 20230870 Project Name: Mica Ridge County: Durham The Division has recei--ed an acceptance letter fi•om the _NC Division of Mitigation Services (DMS) to partially satisfy the mitigation requirements set forth in the Buffer Authorization issued to Charlie Yokley and Lenriar Corporation — Raleigh DFvision. dated August 17th, 2 02 3. as provided in the table below, Compensatory Mitigation River and 8-digit HUC Number Meuse Buffer 70,835.77 square feet (credits) Meuse 1 03020201 Inside Falls Lake Watershed Sorry again about the confusion on this one! Aside from some of the providers not having the credits needed and Debbie Shirley needing to modify the mitigation arrangements, there is also some confusion regarding the buffer mitigation required. This was requested as an impact in the Falls Lake Watershed. DMS accepted it as inside Falls. The mitigation form doesn't appear to require Falls Lake buffer credits (attached). I also noticed that Restoration Systems/Davey proposed to use the Weaver Farm bank- since that is not a Falls Lake bank and their MRT form indicates this is a Neuse 03020201 mitigation requirement, I started to think that maybe this is not a Falls Lake requirement. Can you please confirm? If it is Falls Lake, can we update the MRT form so it says Falls? I can do that and simply add Fall Lake Watershed to it but don't typically change a form without asking. Note as well that I foolishly updated a project form and checked the incorrect box on the first page, but now that it is signed I cannot correct. We did check with banks and for the additional 96,132 SF needed, we received SOA's from three of the five. I have attached the emails supporting this information. Note that the total project needed 130,887 and Wildlands has already invoiced for 34,775 so the SOA attached for Wildlands includes this amount plus the additional buffer credits that they had. Please let me know if you have any questions. Thanks, DEBORAH E.
