Good afternoon Ms. Parker,
On August 28, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until all of the following information is received:
1. The owner listed for the subject project on the application is West Point Cove at Lake James with their email
being listed as [e-mail]. The agent authorization form provided with the site plans is
signed by a Joseph Thomas, Manager— West Point Cove at Lake James, LLC. For applicants that are
corporations, the name and address of the NC process agency, and the name, address, and phone number of the
individual who is the authorized agent of the corporation and responsible for the activity for which the
certification is sought must be included with the application. The corporation must also be registered with the
NC Secretary of State's Office. Please confirm that Mr. Thomas is the authorized agent for West Point Cove at
Lake James, LLC, and that the email provided on the application is his. [15A NCAC 02H .0502 (a)(3)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by September 29, 2023. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
