The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. It is the Division's understanding that the USACE conducted a recent site visit which resulted in an updated Jurisdictional Features map. Please provide the Division with a copy of the updated JD map. 2. Please provide a copy of the most recently DEMLR approved mining map. 3. The stated purpose of the proposed roadway is "to access high ground". In order for the Division to confirm that the design of the proposed upgraded crossing is avoided and minimized to the maximum extent, please provide a more specific indication of what activities will be undertaken within the proposed "high ground" and a justification for the proposed width of the road crossing based on the proposed future use of the area. 4. In order to document that existing uses will be maintained within the stream above and below the proposed crossing, please provide detailed information regarding the width of the natural stream at the OHWM. If the proposed culvert is substantially wider than the natural stream, please provide design details, such as sills, baffles, or use of base flow and storm flow culverts which will ensure that the natural pattern and dimension of the stream above and below the culvert is maintained. Please provide a construction sequence or design plans that adequately document that the culvert will be installed "in the dry'. Please ensure that any temporary impacts necessary to meet this requirement are included in the requested impact amounts. 6. Please clarify if DEMLR will require the installation of a riprap apron below the culvert for energy dissipation. It is the Division's experience that this is a standard DEMLR requirement for all culvert installations. Impacts from any riprap aprons must be included in the proposed application totals. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
