The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: The PCN for the subject project was signed by you and lists the project applicant (i.e. the project owner and entity responsible for compliance with the water quality certification) as Commonwealth Development Corporation of America. Title 15A NCAC 02H .0502(a)(11) requires an agent authorization letter if an agent signs the application on behalf of an applicant. In this case, as the applicant is not the property owner, the landowner authorization signed by Carl and Kathleen Stamm does not satisfy the requirements of the aforementioned administrative code. Please provide an agent authorization form signed by Commonwealth Development Corporation of America granting you signature authority, or alternatively, confirm Carl and Kathleen Stamm are the project owners. 2. All work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact with the disturbed area. Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during culvert replacement. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. [15A NCAC 02H .0506(b)(3)] 3. According to the state stormwater permitting map, it does not appear that the City of Brevard has a state - delegated local government stormwater program. Therefore, our 401 & Buffer Permitting Branch will be responsible for reviewing the proposed Stormwater Management Plan (SMP). Please provide a complete SMP including all appropriate supplemental forms, O&M agreements, calculations, drawings, etc., that complies with the requirements of the State Stormwater Program. The Stormwater Design Manual and applicable forms may be found on the DEMLR's website at https://deg.nc.gov/about/divisions/energy-mineral-land-resources/energy- mineral-land-permit-guidance/stormwater-bmp-manual. Please also submit the application form SWU-101; however, the application fee and last two signature pages of this form are not required and may be omitted. The SMP package (electronic files) may be submitted via our online portal or emailed to our 401 Stormwater Engineer, Chonticha McDaniel at chonticha.mcdaniel@deg.nc.gov. [15A NCAC 02H .0506(b)(3)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by July 14, 2023. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
